(6.l2B.Standards Applicable to Conditional Use Permits. The approving body shall review the particular facts and
circumstances of each proposed conditional use and shall find adequate evidence to show that the proposed use will:
l- Constitute a conditional use as established in Table l, Zoning Districts, and Table 2,
Land Use Schedule.
2- Be in accordance with a specific or general objective of the City's Comprehensive Plan and the regulations of
this Ordinance.
3. Be designed and constructed in a manner to be harmonious with the existing character of the neighborhood and
the zone in which the properfy is located.
4- Not create a nuisance or safety hazard for neighboring properties in terms of excessive noise or vibration,
improperly directed glare or heat, electrical interference, odors, dust or air pollutants, solid waste generation and
storage, hazardous materials or waste, excessive traffic generation, or interference with pedestrian traffic.
5. Be adequately served by essential public facilities and services such as access streets, police and fire protection,
drainage structures, refuse disposal, water and sewer service, and schools. If existing facilities are not adequate, the
developer shall show that such facilities shall be upgraded sufficiently to serve the proposed use.
6. Not generate traffic in excess of the capacity of public streets or access points serving the proposed use and will
assure adequate visibility at traffic access points.
7. Be effectively buffered to screen adjoining properties from adverse impacts of noise, building size and resulting
shadow, traffic, and parking.

1. On April 23,2072,I(urt Roland of Eagle Rock Engineering, presented to the City of
Rexburg Planning &ZonngCoordinator a request and applii"tion for a Conditional Use
Permit to allow structffes with twenty-fow Q4) units p.ibrilding. The property is located
at approximately 900 South 5'h West.
2. On Apdl 24,2072, the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper on Apd 28 and May 1,2,2072. A notice was postei or the propery and
sent to all property owflers within 300 feet of the above mentioned prop"rty.
3' On May 17 ,201,2, Kurt Roland presented to the Planning & ZonngCommission for the

4. On June 06'2012 at Cify Council Troy Kartchner from Logan, Utah presented aptoposal on the Steiner property for larger buildings and a preliminary plit. He reviewed the
overhead slide of the 20 acre parcel off 5'h West. There willbe three entances into the
community housing. Twenty-fout unit buildings allow for more green space, and over timethis type of communi|y marntatns its value at a higher level than " fo*-it"* community. The
street-scape will have trees. The buildings will be three story buildings. -hi-tr"y, will be
y;d for venting on the roof. There will be a club house with consdction planned for eadyfall'201,2. Widening will be tequired fo1 5'h West; they are working on traffic studies with city
staff. Council Member Merill agreed the larger buildings would look better than four-plexes.
Council Member Smith reviewed the main entrances on the site plan. One entry wili come
from a new road off 5'h \X/est running west; a second access *il Le off 5'h 'ifesc the thirdaccess will be off Universiw Blvd.
