HomeMy WebLinkAboutResolution 11-10-1978 (5) Constituting the Filing of a Claim PursuantCouncilman Barton Jensen introduced the following Resolution No. 5 in writing and moved its adoption: RESOLUTION NO. 5 Constituting the Filing of a Claim Pursuant to the Act of November 10, 1978 (Public Law 95 -629) 1. The City of Rexburg, Idaho hereby claims the federal share ;$450,000 of Project No. 14, which project consists of purchasing property and constructing parking facilities in downtown Rexburg, set out in Summary of Remaining Economic Adjustment Measures from the Adjustment Program for Teton Disaster Area dated June 1977 and the summary of the document by number and the federal share as listed on pages 5 -19534 and S -19535 of the Congressional Record of October 14, 1978, and authorized by Section 13 of the Act of November 10, 1978, Public Law 95 -629. 2. No other claim under the Teton Dam Disaster Assistance Act program for the same or a substitute facility described in the above program has been filed by this organization or, if so filed, is withdrawn. The above project was not otherwise funded prior to November 10, 1978. Sufficient funds over and above the Federal share are now or will be available to fully complete the described project_ 3. All the federal. share of funds made available for this project will be kept separate and apart from all other funds available for the project. Any federal funds which are not utilized for the above - specified project, for any reason, will be returned promptly. Any interest earned on federal funds made available for this project will be returned promptly to the i Regional Director, Pacific Northwest Region, Bureau of Reclama- tion, Boise, Idaho. 4. This organization will establish and maintain accounts and other books and records, separate and apart from its other records, of all expenditures and transactions pertaining to the above- described work. The records must identify all costs, .including equipment purchased, contractor earnings, labor, equipment use, materials, supplies, and supervision. Progress reports will be furnished to the Bureau of Reclamation quarterly of the status and costs of the project until it is completed. 5. Representatives of the United States have the right, during regular office hours, to examine the work and all records associated with the work. If an audit discloses payments for costs which cannot be supported or for work, materials or other expenditures not authorized for the project, the United States will be reimbursed for such costs within sixty (60) days after 'written notice of disqualification of the costs. All records supporting the expenditure of funds for the above work shall be retained for at least three (3) years after the completion of the project. jMror `o e City of Rexburg, ,--,,Idaho.
