ment of principal of and interest on said bonds, and any such principal or interest falling
due at a time or times at which proceeds of the taxes herein levied are not available in an
amount sufficient to pay such principal or interest, shall be paid from the general fund of
the City of Rexburg and reimbursement to the general fund made from the proceeds of said
taxes when they shall have been collected."
Section 2. That all ordinances and resolutions or parts thereof in conflict
herewith are to the extent of such conflict hereby repealed, and that this ordinance shall
be published in one issue of the Rexburg- Journal, the official newspaper of said city, and
shall take effect and be in Pull force immediately upon its passage, approval and publication.
Section 3. That if any section, paragraph, clause or provision of this ordinan
shall ever be held invalid or unenforceable, such holding shall not affect the remainder o f
this ordinance, which shall continue in :force and effect to the same extent as if said in-
valid or unenforceable portion had not been included herein.

PROVIDING FOR ITS MEMBERSHIP: SETTING THEIR TERMS OFFICE:
PROVIDING FOR THE FILLING OF VACANCIES: PROVIDING J~6R ITS MEETINGS
AND DUTIES: AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN
CONFLICT WITH THIS ORDINANCE AND PROVIDING FOR THIS ORDINANCE TO TAKE
EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG, IDAHO:
TRAFFIC SAFETY COMMISSION
SECTION I: CREATION: There is hereby created and established a commission
to be known as Rexburg Traffic Safety Commission."
SECTION II: MEMBERSHIP AND TERMS OF OFFICE: The Traffic Safety Commission
shall consist of ten (10) members to be appointed by the Mayor, with t17e consent and approval
of the Council. Members of said commission shall hold office for a period of six (6) years
each and said terms shall be staggered in such a manner so that the terms of not more than
four (4) members shall expire in any (1) year. Two (2) of such members shall hold office
for a term of three (3) years; four (4) for four (4) years, and four (4) for six (6) years,
the respective terms of office to be determined by lot at the first meeting of the commission.
Thereafter, the term of office for each appointive member shall be six (6) years.
Members shall be selected so that there shall always remain in the commission
one (1) school administrator; one (1) City Engineer or public works director or personnel
director; one (1) city judge or magistrate; one (1) county commissioner; one (1) chief of
Police; one (1) city attorney, and four (4) local citizens, and shall serve without compensa-
tion.
SECTION III - VACANCIES: Vacancies shall be filled by appointment of the
Mayor, with the consent of the - Council.
SECTION IV - ORGANIZATION: The commission shall elect its own chairman and
secretary, and create and fill such other offices as it may determine necessary, and adopt
such rules as it shall deem necessary to carry out its purposes.
SECTION V - MEETINGS: The commission shall hold one (1) regular meeting
eacli month for not less than nine (9) months in each year. A majority of the appointive
members of the commission shall be necessary to constitute a quorum at any meeting. All meet-
ings shall be open to the public. A written record of its meetings, resolutions, findings,
and determinations shall be kept, which shall be a public record.
The commission may require the attendance at any meeting of such other City
Officials as it may deem necessary.

the State of Idaho Plan; to make suggestions for projects designed to increase safety in ped-
estrain and school traffic in the Citv and to generally recommend to the Council plans to
improve traffic safety in the entire City of Rexburg.
SECTION VII - ALL ordinances, resolutions, orders or parts therewith, in con -
I ' i flict herewith are hereby repealed, rescinded and annulled.
SECTION VIII. This ordinance shall be in full force and effect from and after
!its approval, passage and publication, as required by law.

Improvement District is creates after contracts for the construction of said improvements have
been let; said assessment roll shall contains among other things,,,the number of the assessment!
the name of the owner if known, or if not known a statement to that effect, a description of
each lot or tract assessed and the total amount of the assessment; which assessment roll., upon'
its completion shall be certified to the City Gouncil�byisai!d °Committee on streets and said
City Engineer. Whereupon, the City Council will ''fix d time wlreri objections thereto by the
property owners in said District will be heard and will cause such assessment roll to be filed
in the 'office of the City Clerk.
SECTION 7. The public notice calling >for' bids l fd• cdristru'cting said improvements here-
tofore having been given by the Mayor and, City, Clerk ,in, th -rge, consecutive weekly issues of
the Rexburg Standard, the official newspaper of said ,City „ if Iiereby,con£irmed. Said notice
stated the time, place and hour when and where the 'City Cler,k,jdoxild receive sealed proposals
for the construction of such improvements ,,and.whi_'ch'notico contained a- :g;eneral description
of the kind and amount of work to be done,- the`materia to be'furn as nearly accurate
as practicable, using such general terms as,to admit lo f the widIest latitude for competition,
and stated that the plans and specifications_.for said improuem'n,ts were on file in the offices'
of the City Clerk and City Engineer to be examined or obtained'at either office. The notice
also stated the amount of the estimate of the cost' of said iiriprovements, and that each bidder
should accompany his bid with a certified 'check or bid 'bond'in "the amount of 5 per cent of the
bid in case the contract is awarded to such bidder and if h,e,fails or refuses to enter into
the contract and.give. the bond required, the proceeds of -such check to be forfeited to the
City as liquidated damages and placed in the Local :Improvement Fund for said District Said
notice,reserved the right to reject any and all bids, to waive informalities or to accept the
proposal of the best responsible bidder. `Also, said notice stated that no bidder may with-
draw his bid after the hour set for opening bids.
SECTION' 8. All ordinances ar parts thereof in conflict herewith are hereby repealed.
SECTION 9. By reason of the fact that the construction of said improvements is impera-
tively necessary, it is hereby declared that an emergency exists, that this Ordinance is nec-
essary to the immediate preservation of the public peace and safety, and that it shall be in
full force and effect from and after its passage', approval and publication as provided by
law.
