On September 11, 2008 our office received a set of plans for "Stone Brook Apartments — Phase
II" on Block 1 Lot 3 of Westates Subdivision No. 1, Rexburg, Idaho. The submittal appears to
be incomplete and cannot be reviewed nor approved at this time. Please revise and resubmit the
plans and specifications in accordance with the following comments so we may complete our
review.
1. This current submittal is for "Phase II" of Stone Brook Apartments. DEQ does not have any
record that water and sewer plans and specifications for "Phase I" of Stone Brook Apartments
were submitted or approved (Block 1 Lot 2). Please submit the as- constructed record drawings
( "as- builts ") for Stone Brook Apartments Phase I for DEQ review and approval. Be sure the
record drawings include both the potable water and wastewater infrastructure for the apartment
complex. The record drawings must be stamped, signed, and dated by the professional engineer
who provided the inspection services to verify the actual construction that occurred. Phase I
must be approved before DEQ will continue our review of Phase IL
2. There are no engineering specifications included with the September 11, 2008 plans. Please
provide the construction specifications for both the water and sewer facilities that will be
constructed.
3. Please include plan and profile views of all water and sewer construction in the resubmitted
package.
4. Please provide the owner's contact information (name, mailing address, telephone number,
email address, etc.) so we may correspond directly with the owner (and c.c. the engineer) in all
future submittals related to this project. The owner is the entity obligated to comply with Idaho
Code and Rules related to the construction of this project; therefore, all future correspondence
will be directed to the owner. This information can be supplied by filling out the General Plan
and Specification Review Checklist available on DEQ's website (see Item 46, below).

Conditions
1. All standards in Section 6.13 for Conditional Use Permits ( Development Code 926) shall be met.
2. The developer shall work with City staff to mitigate glare to neighboring properties.
3. The developer shall work with City staff to meet all parking concerns.
4. There shall be buffering from neighboring properties to the west and to the south of the development by using the
same kind of buffer used in Stonebrook Apartments Phase 1 ( a 2 foot berm with a 6 foot fence on top of the berm).
5. All staff review comments are included in the conditions for this Conditional Use Permit.

5. An engineering inspection contract was not provided with the plans. Please have the owner
provide a copy of the signed contract that identifies the professional engineer that will provide
construction inspections and prepare and submit the as -built record drawings upon completion of
construction.
6. Please complete and submit the following DEQ checklists with the plans and specifications,
available at hitp: / /www.deg.idaho.izov /water /assist business /engineers /checklists cfm
a. General Plan and Specification Review Checklist;
b. Drinking Water Distribution System Checklist; and
c. Wastewater Collection System Checklist
7. Prior to DEQ approval, the City of Rexburg must provide this office with a "Will- Serve"
letter stating that the city will provide water and sewer services to the Stone Brook Apartments
development (Phase I and II). Please have the city submit the will -serve letter directly to our
office.
8. Please provide ownership, operation and maintenance information for both the water and
sewer systems. Who will be responsible for operating and maintaining the systems? If either the
water or sewer are on private property, please provide documentation of any easements and /or
other contracts that indicate who will provide O &M.
9. Please provide three (3) complete sets of plans and specifications with the re- submittal. Upon
approval by DEQ, one set will be returned to the owner, one set to the engineer, and one set will
be retained by DEQ. An approved set of plans and specifications is required to be on site at all
times during construction (either the engineer's or owner's copy).

We have reviewed the plans and specifications for the Stone Brook Apartments Phase 11 water and
sewer improvements. The plans appear to meet state standards and are hereby approved.
This approval is for system design only. We will give final project approval after it is established that the
system is operating properly. Please keep this office informed of the scheduling of all construction
phases so that we can make spot inspections as necessary.
One complete set of DEQ- approved plans and specifications must be kept on site during construction,
including any additional specifications or rules called out in the plans (ISPWC specifications and the
Idaho Rules for Public Drinking Water Systems, for example).
Within 30 days after construction, a professional engineer licensed in the State of Idaho must provide this
office with as -built plans or a letter of certification stating that the project was installed with substantial
accordance to the approved plans.
A copy of the approved plans and specifications will be kept on file at this office. Please reference DEQ
No. 08 -17 -33 when submitting any future correspondence related to this project. If you have any
