SPECIAL CONSTRUCTION (MANUFACTURER OR SUPPLIER) ] 4 v, 2/25/2002 Lance Godfrey 344 West 4 South Rexburg, ID 83440 Dear Lance, It has come to my attention that the upstairs unit of the addition that you recently added to your office located at 344 West 4 South in Rexburg, Idaho is being used as part of the existing apartment. I have attached a copy of the letter that I sent to you dated 10/18 /2001. In this letter you are instructed that the upstairs portion of the addition could not be used as residential space. You were also informed that the upstairs portion of the addition could not be rented out as office space unless it was included as part of the unit below. If it is your intent to use the space as an addition to the existing apartment, I will work with you towards this goal. We will not allow an additional apartment in this building because the one that it existing is not compliant with the zoning. Using the space to increase the size of the existing apartment makes some sense when you consider that an entry has been created that meets the Building Code. I will work with you as a condition that the upper floor shall have only one apartment and will remain that way unless a variance is secured to allow another use. The other option would be to use it combined with the lower office unit as it was identified during permit process and open it up to the office below as per the plans. The 1997 Uniform Building Code requires that a one -hour fire separation be constructed between the office and residential spaces. This would require a minimum of two layers of 1/2" drywall on the office ceiling. It has also come to my attention that the other office areas that were existing prior to the addition contain ceilings that are either incomplete or lacking the second layer of drywall to be considered a one -hour separation. These ceilings need to also be properly constructed. The one -hour separation was a requirement when the first apartment was created. Please contact me and let me know how you plan on addressing this issue. If I haven't heard from you by March 12, 2002, I will require all of the lower level business to vacate, or the apartment dwellers to vacate. First, the bathroom is not fully accessible. A grab bar is needed behind the toilet. Also proper identification signage is needed on the restroom door. Second, you will need to provide fire extinguishers in both levels. Finally, make sure that the address is clearly visible from the street. Once again let me remind you, that the upstairs can't be used as a residence because of the zone that it is in. It also can't be used as a separate business open to the general public then that of the lower level. The upstairs is not accessible and therefore must be used in conjunction with the lower level whenever the occupancy is that of a business that is open to the general public. A handicapped person while on the lower accessible level must be able to do any activity that is being offered to the general public on both levels. Otherwise a case of discrimination can be filed. I was disappointed to read that additional changes would have to be made to use the property as I had planed. My disappointment is not with you but that the contractor did not convey to me the problems that you discussed. I sat with you I Believe at the beginning and was told that I would not be able to have another apartment up stairs as per my original plan. I also stated at that time I wanted the addition for more room in the upstairs Managers apartment. I have no intent to rent this out as a separate apartment or office. I do understand that it would have to be combined with the down stairs if rented as office. I appreciate your willingness to work with me. It sounds to me that what I need to do is to remove the dropped ceiling and lights install the one -hour firewall and then replace the drop ceiling. Is that correct? If so I have already started on getting some bids to get this done. I would like to have you meet with the contractor and I on Tuesday the 5 at 1 pm to make sure we understands what needs to be done. As far as the older existing building I did complete all requirements to rent that out that were given to me buy the building inspector. If you have any letters or information issued to me to the contrary I would be happy to look at it. I have been renting these offices and apartments out for several years I did not just start renting them out his year. There are several problems that would need to be addressed in order to bring this up to the same code you were talking about on the new addition. The heating system and ductwork is shared amongst all 3 tenants. This would create large compromises any firewall we installed. The power and conduits run back and forth and are not billed separate. I would like to get the power, heat and utilities separated as I can. I would like to take a look at these as they vacate.
