FOR PARTIAL BUILDING CONSTRUCTION
TO: Building Official for the City of Rexburg
Pursuant to the provisions of the Uniform Building Code, the undersigned requests that a
building permit be issued for:
Permit for footings and foundation only on medical building.
Acknowledgment is made that the plans for the complex are not complete and that final
approval of the building will not be given until the final plans have been approved. We
recognize that proceeding with partial construction at this time is entirely at the risk of the
Architect/Owner with there being no assurance that the final Certificate of Occupancy for the
entire building or structure will be granted.
We further absolve the City of Rexburg and officers and employees thereof, of all responsibility
for the issuance of a partial permit and further agree that any work performed under this permit
will be removed or otherwise corrected to be in accord with the requirements of the final
approved plans when a permit for the entire building or structure is finally granted.

Motion was made by Bobbette to approve the minutes of July 25, seconded by Ladawn. All

Discussion of the McDonald's sign and the Erickson Pontiac sign.
Cory Newman - Site Plan Approval for Apartments at 37 So. 4 West
John Millar reviewed the plans which had been presented for approval. The property is across
from the canal with a current zone of MDR. There is an existing house on the front of the lot,
the plan is to build a 4 -plex behind, it meets the setback requirements, there are 8 parking stalls
meeting the requirements. On the rear yard and on the south side yard the asphalt is shown
going right to the property line. It needs to be discussed if this should be a buffer, fence or both.
Cory explained he is building married student apartments, the first building in front will be a
duplex with 12 parking spots, the manager will live upstairs with the 2 parallel parking spots, 3
gentlemen will live down the basement with use of the parking behind the 4 -plex in back.
Discussion on the drainage going north on 4t West and a fence. The plans need Fire
Department approval, it is a situation where they have to back out and one lot deeper would
definitely need a turn around big enough for a fire truck.
Dick made a motion to approve the site plan subject to approval of the Fire Department, subject
to acceptable drainage worked out with the City Engineering Department, a fence on the south
side and a 5' buffer or fence on the east side. Motion was seconded by Doug, all voted aye, none
opposed.

Gene Palmer - Final Plat Review for Hidden Valley Estates Phase III and Preliminary Plat
Review for Phase IV
One issue before the Board is the final plat on Hidden Valley Estates Phase III which consists of
16 lots which are basically west of Phases I and II. There are some review items but will be
followed through by the City and the in -depth mathematical review by the County.
On the preliminary plat review on Phase IV, they have basically added 4 lots to the south end of
Phase II which extends the existing road for two more lots.
Gene explained the purpose for Phase IV is to comply with commitments to different people in
the subdivision. Discussion of the access, a 40' greenbelt and a 10' walkway around the cul de
sac into the proposed city park, and extension of the street. Phase III has a few alterations
between Lot 1 Block 2 and Lot 1 Block 1 taking some footage away from Block 1 and giving it
to the corner on Block 2. The water and sewer are in and being tested now, as has been their
practice the curb and gutter is in but they will forego the paving until next spring.
The master plan for everything below the Woodmansee- Johnson canal is complete and another
plan is being drawn for the project on the other side of the canal. Discussion on the streets.
John reported that Phase III and IV have been reviewed and there are no real problems. It is
requested that no new phases be approved until there is a new overall master plan. The new plan
needs to come back before the Board for review. Gene reported this master plan should be
presented within two weeks.
Dick declared a conflict of interest.
Ted made a motion to approve the final plat on Phase III subject to City Engineering review.
Motion was seconded by Bobbette, all voted aye, none opposed. Dick abstained

John Millar reported that this is a development of a lot in the southwest corner of Madison
Professional Park located on the south end of Ash. The south line is adjoining the Rosewood
Addition. The only problem with the setbacks is the issue of the south and west edge of that
property which will require buffering with either a fence and/or buffering. The other problem is
an engineering issue, they would like to find a better way for the sewer than to go 250' across the
parking lot.
Stan Palmer, architect for Dr. Davis, discussed the location of the sewer. He presented an
updated copy of the plan, there is an existing sewer manhole which he was not aware of
approximately 40' from the existing asphalt edge of the property. This is a sloping site, with the

setbacks, to get enough parking for the requirements of the City they have to have a small
parking lot along the south side. There is approximately 5000 sq. ft. of finished space in the
building. Discussion of buffers, traffic, parking requirement of 25 stalls, the location of the
dumpsters and the need for addresses on Ash Street rather than Madison Professional Park.
Dick made a motion to approve the plan subject to a fence on the south and a buffer on the west
and appropriate City Department approvals. Bobbette seconded the motion, all voted aye, none
opposed.
For information only, Ted discussed a proposed project for student housing located on property
on 2" East next to the armory.

It has come to my attention that two items mandated by the Plot Plan Review for
your new building in the Madison Professional Park have not been completed. A fence
on the South alongthe Rosewood Subdivision and a buffer on the West side of the
property are required as per the ruling by the Rexburg Planning and Zoning (P &Z)
Committee. I have attached a copy of the minutes of the P &Z meeting to the back of this
document. Please finish these two items.

I have reviewed your drawings for the Davis Medical Building. Below is a list of
items that need to be included or changed:
1. Please provide accessible bath details as per the 1997 Uniform Building Code
(UBC) Section 1105.1.
2. Provide truss details. It is nice to have these at time of review, but I must
have them prior to frame inspections.
3. Provide a list of storage items that will be kept in all storage areas.
4. Please show exit signs at the back entrances and leading to these entrances as
per 1997 UBC Section 1003.2.8.2,
5. Please show an attic access opening as per 1997 UBC Section 1505.1.
6. Provide attic space venting details as per 1997 UBC Section 1505.3.
7. Show draft stop as per 1997 UBC Section 708.3.1.2.2.
8. City ordinance requires that foundations shall be constructed at a minimum of
36" below grade for frost considerations. If this requirement can't be met due
to the position of the bedrock, it is acceptable to place concrete directly on the
rock surface. The rock must be cleaned prior to concrete placement.
9. Please provide shear wall details. Include wind calculations used in design.
10. Show sewer service connected to the sewer main, not to the manhole.
11. Address the Fire Department issues. 1 have attached their review at back.
