Both Janell Bryan with Ranch Creek Development and Jim Hall of Eastern Idaho Special Services Agency seemed interested. We supplied them with a cost estimate for the construction of the utility lines. I have attached a copy of the estimate to the back of this letter. Our concem is that the parties involved will not have reached an agreement in time so as not to delay our construction. We are committed to have our building and lot ready for occupancy by the 1' of August 2001. Our plans have been approved with service lines located on our property. As we will not stand to benefit financially from the addition of the recommended joint use utilities, it is not in our best interest to pursue the venture unless it can be brought about in a timely manner. I have sent each of the parties a copy of this letter as well as a request for action regarding the issue. Swiss Farm Court Midway, UT 84049 Dear Janell, I hope you have had some time to consider if you are interested in the construction of joint utilities at the properties you are acquiring from Bruce Sutherland in Rexburg, Idaho. Due to the deadlines that we are facing with our construction, it is necessary that we begin construction on the utility lines as soon as possible. If you want to pursue the effort, we need to get together with Eastern Idaho Special Services Agency (ESSA) and yourself to work out the usage and length factors for cost breakdown percentages and to determine utility location. I would then need to make up some drawings for bidding purposes. We must have your commitment on this project by May 25, 2001. If either ESSA or yourself do not make the necessary commitments by this date we will begin construction on the utility lines as per our approved drawings. I hope that this quick time table does not cause you too much grief. I have attached a copy of a letter that I sent to John Millar with the City of Rexburg.
