I am writing you to inform you that the building permit for Paddington Court
Apartments lapsed on June 4 , 2003. Section 106.4.4 of the 1997 Uniform Building
Code (UBC) requires work to be commenced on the site within 180 days of the permit
issuance. Our observation of the site revealed no appreciable activity. If you disagree
with our observations, please provide us with documentation that would substantiate
construction activity relative to the building permit taking place prior to June 4 In the
meantime do not commence or continue any work that would require a permit until this
matter is resolved.
We do not anticipate any additional building permit fees. A new plan review fee
will be required as revised plans will have to be resubmitted for compliance to the 2000
International Building Code (IBC). Please have your architect make the necessary
changes. The existing plans will not meet the new code. Please provide me with 2 new
stamped copies of the corrected plans. If you have any questions, please give me a call at
359 -3020 ext. 324.

Dear Holly,
I am responding to your letter addressed to me on September 28, 2005. As I indicated in our last
correspondence, our records do not substantiate the timelines that you indicated in your letter. First of
all, the building permit is for the buildings. Water lines and sewer lines are permitted with a plumbing
permit. Our records do not show that a plumbing permit has been taken out for this project. The last
building inspection for Paddington Court was performed in 2003. If you have any questions, I can be
reached at (208)359 -3020 ext. 324. Currently the permit issued on December 31, 2002 is considered
to have expired as per the 1997 Uniform Building Code, Section 106.4.4, and any further action on
your part will require application for a new permit.

a path of activity that would warrant continuance of the building permit. Our records do not

Dear Val:
I am writing in response to your letter dated 7/9/03, which I received on July 11, 2003 regarding
the status of the building permit for the above project.
The building permit for Paddington Court Apts. was issued on December 31, 2003, (copy
attached) therefore in accordance with Section 106.4.4 of the 1997 Uniform Building Code
(UBC) work was to commenced on or before June 29, 2003. In fact work started prior to that
time. As of June 29, 2003 in addition to the site having been cleared and layout completed, the
sewer had been extended into the property, and the site had been cut to sub -grade and excavated
for footing placement. Footings and Foundations were originally scheduled for the week of June
29, 2003, however the subcontractor performing this work was delayed and rescheduled for July
10 2003. Upon receipt of your letter, Mr. Montgomery canceled this date and has now
tentatively scheduled this work for the week of July 14 2003.
In as much as we have complied with the time requirements of the UBC, we have been advised
that a new plan should not have to be submitted for compliance with the 2000 IBC, and therefore
we would like to move ahead as soon as possible. Please advise.

As per your request enclosed is verification of the work completed during the timelines
referred to in my earlier correspondence. As you can see the work permitted for has at no
time been inactive for 180 days as stated in your correspondence dated 7/27/05.
12/30/02 — 6/30/03 Letter Dated July 10, 2003 from Greg Stoddard verifying
work completed. As you recall it was based on this work
having been completed that the project was deemed to be
in compliance with the code, and therefore the Permit was
valid and we reissued the Check for $55,164.00 and
continued working on the project.
6/30/03 — 12/30/03 Excavation/Sewer /Layout - Survey, Concrete. Billing from
Depatco, Inspection Tickets dated November 14, 18, 21,
25; December 8 & 11. Concrete was completed first part of
January 2004.
12/30/03 — 6/30/04 Complete Sewer System. Work was performed May and
June 2003, Testing was performed on June 18 and Keith
Davidson, Rexburg City verified work passed
requirements.
6/30/04 — 12//30/04 Work on Water System. Passed Pressure Test on
December 17, 2004, Kip Orme, Rexburg City Water.
Received Letter June 10, 2005 verifying Sewer and water
meets state standards.

12/30/04 — 6/30/05 Sub -Rough Plumbing was Commenced and completed
prior to June 15, 2005 David Montgomery first called for
Inspections on or about June 7, 2005, however, inspections
have not yet been completed. Mr. Montgomery made one
or two additional request for inspections prior to receiving
your letter dated 7/27/05.

Dear Val:
Your letter to Mr. Montgomery in response to his inquire as to why the plumbing
inspections have not yet been completed stated that the permit for Paddington had
expired due to the project being inactive for 180 days. The project is not nor has it ever
been inactive for 180 days. At this time we are awaiting inspection of the work
completed in May and June of 2005 so that we can continue.
As you recall the permit for the project was issued on 12/31/02 (copy attached). In July
2003 I received a letter stating that the permit had expired. Based on that letter I stopped
payment on Check # 1015 for $55,164.00 that had been issued to the City of Rexburg for
balance of fees until such time as we could resolve this issue. On July 30, 2003, based on
the understanding that the Permits were in fact valid and would remain so as long as work
did not cease for 180 days, Check #1063 was issued for $50,164.00. Since that time the
project has not been inactive for 180 days and the work completed has been inspected
and/or tested by the proper agencies.
Concrete work was completed between June 2003 and December 2003. Between
December 2003 and June 2004 Sewer systems were installed. City of Rexburg was
called on June 18, 2004 to witness testing of main sewer lines. Between June 2004 and

December 2004 water systems were installed. They were tested and/or inspected on or
about December 17, 2004. Between December 2004 and June 2005 the sub -rough
plumbing was completed and we are awaiting inspections for this work so that we can
continue. As you can see at no time has the project been inactive for 180 days and
therefore the permit has not expired.
If you have any questions please call I would be happy to meet with you and or Mr.
Zollinger if necessary. Your assistance in scheduling the required inspections would be
greatly appreciated so that we can complete the work scheduled for this fall.

To whom it may concern.
DePatco Inc. installed a sewer system on thc Paddington Court Apartment complex located in thc Westates
Subdivision, Rexburg, Idaho. This work was completed during June of 2004. The sewer system was installed
and tested. The City of Rexburg was called to inspect and on June 18 2004 the city witnessed the testing.
The pressure testing of the sewer main lines passed the require,ments'for sewer system installation.
