Having reviewed the plans for Peaks Plaza at1000 North in Rexburg, I have come
to a couple of conclusions that should be brought to your attention. They are as follows:
1. The amount of parking spaces provided for this building will limit the type
of business that will be able to rent the tenant spaces. The building is
10440 square feet in area. 9000 square feet would be classified as either
office or automobile service space. The parking space requirement for
these occupancy classifications is 3 spaces per 1000 square feet of
building. If we identify the 1440 square foot mezzanine storage space as a
warehousing occupancy, it requires 2 spaces per 1000 square feet.
Therefore, the 9000 square feet requires 27 parking places and 1440
storage space requires another 3 spaces, or a total of 30 spaces are
required. Your most current site plan identifies only 23 spaces. If we
ignore the 3 spaces called out for the storage space, we are still 4 spaces
short. 3000 square foot of the building would have to be rented to
businesses that only require 2 spaces per 1000 square feet of space.
Businesses that fit the above parking requirements include Contract
Construction Services, Wholesale Trade and Warehousing. Day Care is
another possibility with modifications to the building.
2. The two -story portion of the building is also limited in its use. The
Americans with Disabilities Act (ADA) protects people with disabilities
from being discriminated against in respect to the accessibility of a new
building. The layout of this building lends itself to problems in regard to
accessibility. The 2 level is not accessible and therefore, the ADA
would require that a business that rents the upper space and the space
below it to provide the same service on the accessible (1 level that is
provided on the non - accessible (2" level. A person with disabilities
should be able to do any business that is being provided in the building on
the accessible level. Also, a business would not be able to perform a
specific function on the non - accessible level that they would not be able to

have identified them to you so that you would be aware of possible situations that could

mail room, a conference room or a copy /media center on the non-
accessible level and not on the accessible level, the business would be
making a statement that persons with disabilities could not be hired to fill
jobs that would require access to the 2 level The situation becomes
worse if the two tenant spaces on the far West are rented out separately.
Then, the tenant has only a reception area and a small office on the
accessible level. Rooms used on the non - accessible level for other than
office space could result in a discrimination case.

Dear Jeff,
Jeff as per your request, I have performed a framing re- inspection on the Peaks
Plaza building. A couple of items had not been addressed. They are as follows:
1. Some of the walls identified on sheet S -2 of the G&S structural drawings
are still missing the appropriate anchors.
2. In my frame inspection checklist that I had recently faxed to you, I had
asked for the special inspection documents regarding the bolt tightening as
per the 1997 Uniform Building Code Section 1701. I have not received
this information, so I took it upon myself to examine the steel and steel to
concrete connections. I found that about i/2 of the nuts on the steel to
concrete connections were loose to the touch. Some nuts were 1 A" above
their washers. Many of the bolts that had been placed in the concrete were
not correctly located. Some of the connections were made by welding the
side of the bolts to columns. Some of the connections are missing bolts
altogether. Also the cross bracing is loose.
I need to have your engineer provide me with a letter describing how connection
corrections will be made. In addition, I still need a copy of the special inspections for the
bolting as well as the welding. If you have any questions please feel free to give me a
