FOR
CONDITIONAL USE PERMIT
1. On December 27, 2002, Leonard Hull presented to the Rexburg City Clerk a Request and
Application for a Conditional Use Permit on property located at 264 North 3r West in the
City of Rexburg, said property to be changed to an apartment.
2. On January 9, 2003, Leonard Hull appeared before the Planning & Zoning Commission
for the City of Rexburg requesting Conditional Use Permit of said property located at 264
North 3r West for an Apartment. It was recommended that this request should go to
public hearing.
3. On January 14, 2003, the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on January 15, 2003, and February 3, 2003. A notice was posted on
the property and sent to all property owners within 300 feet of the above mentioned
property.
4. On February 6, 2003, Leonard Hull appeared before the Planning & Zoning Commission
for the City of Rexburg requesting a Conditional Use Permit for an Apartment on property
located 264 North 3' West. There was no opposition expressed concerning this request.
A motion was made and passed to approve this Conditional Use Permit subject to the
conditions in paragraph 6.13 of the Zoning Ordinance plus the approval of the City
Departments and the life safety issues.

REQUIREMENTS FOR GRANTING CONDITIONAL USE PERMIT:
The following information will assist the Commission and/or City Council to determine if your
proposal will meet the requirements under the zoning ordinance.
1. What is the estimated water usage per month? Are the existing mains adequate to provide fire
protection?
2. What is the estimated sewer usage per month? Will pretreatment be necessary?
3. What is the estimated daily traffic to be generated? Will the traffic be primarily private
vehicles or commercial trucks?
4. If commercial, industrial, or a home occupation, what will be the hours of operation?
5. Will storm water drainage be retained on site? Is an existing storm drain available? Is it at
capacity? If so, will new facilities be constructed?
6. If proposed use is residential, describe number and type of dwelling units. Will this be
student housing: multi - family for young families, singles and cou.les, or elderly,

CONDITIONAL USE PERMIT PROCEDURES
The City of Rexburg Zoning Ordinance designates certain land uses in each Zoning District
which are allowed. These are listed in the Zoning Ordinance for each zone. The City Clerk or
City engineer should be consulted if you have questions about whether your proposal will need a
Conditional Use Permit.
If a C.U.P. is needed, you will need to get an application from the City Clerk and fill it out for a
C.U.P. You will then need to return the application and request that the City Clerk put you on
the Planning Commission agenda one week prior to the meeting. The Planning & Zoning
Meetings are held on the 2' and 4 Wednesday of every month at 7:00 p.m.
The City Clerk will then mail to the Planning Commission the application for them to review
prior to the meeting. At the meeting the board will discuss your request with you and set it for
Public Hearing. You will need to pay $200.00 to the City Clerk prior to any advertising for the
hearing. Prior to granting a conditional use, at least one Public Hearing shall be held to give
persons an opportunity to be heard.
The City Clerk will put the notice for the hearing in the paper 15 days prior to each hearing, mail
a copy to all the property owners within 300 feet and post a notice on the property. After the
Planning Board holds their hearing they will make a recommendation to the City Council. The
City Council will take the Planning Board recommendation into consideration. If a hearing is
required before the City Council they will then take into consideration oral and written
testimony as well as the recommendation from the Planning Board. A decision will be made by
the City Council within the time frame allowed by Section 67 -6511, Idaho Code.

NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning &
Zoning Commission of the City of Rexburg, Idaho, Thursday, February 06, 2003, at 7:05 p.m., in
the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a
Conditional Use Permit (CUP) for an apartment. The location is zoned Low Density Residential
(LDR1).
The said property is located at 264 North 3r West in Rexburg, Madison County, Idaho, and more
particularly described as follows:

Mike Ricks moved to approve the minutes from on the Consent Agenda with minor changes suggested
by Winston Dyer; Jordan Dyer seconded the motion; all voted aye, none opposed.
The motion carried.
Winston Dyer noted that there are two items on the table. One is a Comprehensive Plan change request
in the area of first North and First South on Main Street. The other one is a request for a
Conditional Use Permit for a daycare facility that needed further clarification on some parking
issues. Kurt Hibbert explained the new the site plan that was resubmitted showing parking for
four stalls. The daycare request may be brought off the table later in the meeting.
Zoning Compliance — Kurt Hibbert reviewed the compliant issues list that has been prioritized.
The City is working on them one at a time. There is one complaint that has been sent to the Police
Department to serve on the offender.
Winston Dyer — Reviewed the problems of the off street parking restrictions in the winter. Kurt
responded with comments from apartment owners requesting additional parking. Winston
explained the complaint process that is available for Planning and Zoning issues to the City
residents.
Winston Dyer explained the process for giving testimony at the Public Hearings.
Public Hearing:
7:05 p.m. Conditional Use Permit — 264 North 3rd West - Residential Duplex - Leonard Hull
Barbara Hull — 264 North 3 West — Barbara is working in Rexburg and travels from Ashton. Their
children will live in the home and the home complies with the life safety codes. The basement
has been converted into an apartment. They plan to rent the basement of the home in the future.
Kurt Hibbert - Indicated that the Staff has reviewed the proposal. It is a proposed new use for the
property.

There was no written input on the proposal.
Ted Whyte moved to approve the Conditional Use Permit at 264 North 3 West subject to the conditions
of a Conditional Use Permit in paragraph 6.13 of the Zoning Ordinance plus the approval of the
City Departments and the life safety issues; the motion was seconded by Mike Ricks;
all voted aye, none opposed. The motion carried.
Winston Dyer asked the applicant to review the conditions with Kurt Hibbert for compliance
7:10 p.m. Conditional Use Permit — 228 E. 2nd S. — Residential Duplex — Lee & Marilyn Ward
Lee J. Ward — 133 East 2 South — He purchased the property four years ago with three apartments in the
home. The top apartment was built about 10 years ago without a permit. The other two
apartments have existed before 1977. Lee has had a business license for the property for the
apartments for the last four years. He is asking for a permit for only two of the three apartments.
Lee will vacate the third floor apartment in the spring of 2003. There is parking for 6 stalls is in
the rear of the building. Kurt indicated that the staff has reviewed the proposal. The parking
stalls are adequate for two apartments.

485 North 2 " East - Request for a rezone from Light Industrial (LI) to Highway Business
District (HBD) - Site Plan review included — Cameron Gunter
Cameron Gunter — 1082 East 1200 South Springville, Utah — Reviewed the site plan on the
overhead screen. There were a number of new business ventures reviewed in the site
plan. A greenway would be installed along the South part of the site plan with a walking
bridge across the river. Some of the tenants can not be disclosed due to ongoing
negotiations. Cameron indicated that the site plan proposal is planned under a proposed
mix zone for the development. They plan to have a bowling alley with a pizza shop in
one of the buildings. They are negotiating with a theater to come into another building.
They are hopeful to straighten up the intersection at the Wendy's access off 2 East.
Cameron mentioned plans for a greenway project on the property. They are hopeful that
the City of Rexburg will maintain the green way.
Kurt Hibbert — Reviewed the Comprehensive Plan and the Zoning Map on the overhead screen.
Discussion on the Comprehensive Plan showing the latest changes.
Jerry Hastings indicated that light Industrial was on the East side of the rail road tracks on the
February 2001 map.
Kurt Hibbert - Indicated that the Zoning map shows Light Industrial and the Comprehensive Plan
map shows Commercial for this area. The requestor plans to ask fora mixed zone
overlay at this location at a latter date.
Jerry Hastings — Reviewed the Zoning Map on the overhead screen. Kurt Hibbert indicated that
future zoning for Light Industrial needs to be reviewed.
David Stein — Commented on the need for design standards to be applied to the construction
project proposed for this area.
Mary moved to send this request to a Public Hearing; Ted Whyte seconded the motion;
all voted aye, none opposed. The motion carried.
Cameron Gunter — Indicated that his company would provide a site plan for the Commission
at the Public Hearing.
264 North 3 West — Request for a Conditional Use Permit for a duplex — Leonard Hull
Kurt Hibbert — Reviewed the proposal to convert the basement in the home to an apartment. The
parking has not been reviewed. The Commissioners discussed the location on the overhead
screen. The intent is to have married housing.
Ted Whyte was concerned with the size of the home.

Discussion on other apartments in the area. This location is a block away from Walters
Ready Mix Plant.
David Stein moved to send the request to a Public Hearing; Ted Whyte seconded the motion;
all voted aye, none opposed. The motion carried.
Continental Park Condominiums Final Plat Approval - North West Corner of
5 West -7th South
Kurt Hibbert — Reviewed the proposal with the Commission on the overhead screen. The
proposal is to change the complex to a Condominium Complex with a new Plat.
Discussion on the type of ownership that would be involved with the complex.
Ted Whyte - Explained that it would increase the turnaround time for the developer's
investment. Buying these would be similar to paying rent. Young married couples and
elderly people have shown an interest in buying the units. A Homeowner's Association
would include items like insurance, snow removal and yard care. The Protective
Covenants for this development are being reviewed by the City. The parking
requirements are still 2 parking stalls per unit. This development is called a Planned Unit
Development (PUD).
Jerry Hastings — The Protective Covenants become part of the legal deed.
Discussion on the responsibility of the Commission or the City of Rexburg to regulate
construction projects and construction types. This building project will be utilized to
provide private ownership to students of the University.
Mike Ricks — Indicated a favorable response to the proposal. He commented on the current
traffic delays being experienced on the South side of town.
David Stein — Indicated that it is a good proposal for the low income home buyers.
Ted Whyte — Reviewed parking issues and University controls that will protect the units
from being used as singles units.
Discussion on the response given to the City of Rexburg on apartments that are corning
into compliance. The definition of family needs to be incorporated into the
