Dear Mr. Taylor:
This letter relates to your Certificate of Occupancy for building permit R- 03 -09 -15 and
serves as a reminder of the special condition regarding this occupancy. Originally this
building was permitted for manufactured home to be placed on a basement foundation, a
single - family residence with an unfinished basement (permit R- 03- 06 -11). You then
proceeded to rough in the basement for two apartments, which were not under permit. A
stop work order was issued because of major potential problems related to converting this
building to a 3 -plex. One issue was the governing code would change from the
International Residential Code to the International Building Code. An option was given
to upgrade to the IBC standard or limit the building to a duplex. You declined the IBC
upgrade, and claimed one apartment would be finished and the remaining area of
basement would become part of upper level house. Other issues exist under planning and
zoning that are not addressed in this letter.
The condition of occupancy for the building this letter pertains to is that only two
separate dwelling units may exist therein (the upstairs unit, #3, with partial basement and
one basement unit, #5). This condition may be monitored at any time, and if it is found to
be in violation you would be subject to criminal prosecution.

20 June 2003- Building Plans Approved by Quinton Owens, Building Inspector.
20 June 2003- Footing Inspection Approved by Quinton Owens.
23 June 2003- Foundation and Layout Inspection Approved by Quinton Owens.
3 July 2003- Groundwork Inspection Approved by Kip Orme.
21 August 2003- Stop Work Order issued by Quinton Owens for violation in regards to
permit for Single Family House.
August 2003- Taylors met with Building Dept. to review options. Declined IBC
requirements and opted for one basement apartment. (see letter)
4 September 2003- Date of Application for Residential Building Permit to add apartment
in basement, # R- 03- 09 -15. Second permit was required because first permit was
for single family unit only.
25 September 2003- Paid City of Rexburg Permit Fees in the amount of $628.55 for
permit R- 03- 09- 15.This was required to add one basement apartment.
23 October 2003- Framing Inspection disapproved by Quinton Owens.
28 October 2003- Framing Inspection approved by Quinton Owens.
31 October 2003- Rough -In Plumbing Inspection Approved by Delyne Edstrom.
13 November 2003- Insulation Inspection Approved by Jon Berry.
5 December 2003- Drywall Inspection Approved by Quinton Owens.

Upon review of the site plan drawings submitted the following items need to be
addressed:
1. ACCESS: A turnaround needs to be provided to maneuver fire apparatus. A
turnaround can be provided with a hammerhead, circle, or loop drive.
Additional plans are required to complete an accurate review of this project. If

Dear Sir;
The following items need to be addressed before we can issue your permit for
construction.
1. The Site plan needs to comply with the site plan checklist.
2. Parking for 8 & 9 will not work due to the width required for a drive. The site plan
shows a width of 30' but the actual width is only 25' to� the p roof eave. :1 i S 30'

A trash facility needs to be shown on the property.
Sewer and water lines need to be shown on the site plan with the proper slope shown okettk td for for the sewer line. r —
. The fire department requires a maximum of 150" from a street to a turn around. Bare
street does not have a turn around so the distance starts back at 4 West.
9. As a single family residence or duplex the separation to the property line can be a
minimum of 6', but as a 3 plex the building falls under the International Building Code as
a commercial building and requires a minimum of 10'separation to the property line or
have a 1 hour rated exterior wall and ceiling /roof with no openings or protected openings
allowed and be over 5' from the property line. A parapet must also be provided or and
alternative.
