The project does not violate the 30% landscaping requirements and the setbacks were averaged as per Section 4.9 of the Zoning Ordinance. Building plans meeting the requirements of the 2000 International Building Code were submitted. We did make Dr. Archibald's architect redraw the front porch as it violated the set -back requirements. As far as I know, all of the zoning and building requirements were addressed. I have attached a copy of pertinent zoning info as well as the minutes from the P &Z meeting when the site plan was approved. Let me know if I can be of any further assistance. Compliance with Section 4 -6. The height provisions of this section on fences shall not be construed to permit any structure, fence, wall, shrub, hedge, or sight obscuring object to exist in violation of Section 4 -6 of this Ordinance. 4.8 Parking of Vehicles in Residential Zones The purpose of this section is to protect and enhance property value, to retain the open character of a residential zone, and to protect health and safety byregulating the parking of vehicles within residential neighborhoods of the City. A. Parking of Recreational Vehicles No person shall park or -allow the parking of any recreational vehicle in the clear sight triangles required by Section 4 -6 of this Ordinance. In a residential zone, no person shall park or allow the parking of any recreational vehicle in any front yard or a- side yard facing a public street for a period of no more than four (4) consecutive days and a cumulative of (30) days in a calendar year. (Amended the 20th day of October, 1993; Ordinance No. 753.) B. Parking of Automobiles. No person shall park or allow the parking of any automobile, van, pickup truck, or motorcycle in any front yard located in a residential zone except in a designated driveway. No more than thirty percent (30 %) of the front yard shall be covered with asphalt, or gravel unless a site plan is submitted and approved by the Planning & Zoning Commission. The operation of this section shall be suspended during any period of a snow alert declared by the Mayor. C. Storage of Commercial Vehicles and Manufactured Home in Residential Zones. The storage of commercial vehicles with a gross weight exceeding eight thousand (8,000) pounds and construction equipment including but not limited to bulldozers, graders, and cement mixers shall not be permitted upon private property in any residential zone except for a period not to exceed one (1) year in which a building is being constructed thereon. Unoccupied mobile homes and manufactured homes shall not be stored upon private property in any residential zone -s.__., 4.9 Exception to Setback Requirement When fifty percent (50 %) or more of the lots on the same side of the street have been built, all buildings erected, established, or rebuilt shall be in conformity with the averaged setback of such buildings. In all Residential Zones all buildings erected, established, or rebuilt shall be required to place sidewalks a minimum of seven (7) feet behind the curb and gutter, where conditions permit. In new residential subdivisions the front yard setback may be changed to twenty feet (2 0). Noncontroversial Items: Trees: The Commission discussed the booklet about trees and vegetation in our area. General discussion about the development of the booklet which talks about trees and vegetation in our area. The comments were favorable to accept the b ooklet as a guide for our area. The Chairman requested Devon to spearhead a committee to work on the Tree Project for the Community. Public Hearing: Zone Change from HIM to HDR2 Eric Early Property - North side of 7" S and 3' W John Millar reviewed the request for a zone change with an overhead picture of the existing zoning in the area. The area is about 5 acres. Mr. Eric Early - He wanted to make a more intense use of the property. The request would change the zoning from HDR to HDR2 to allow development of 192 one or two bedroom units for married housing. John Millar stated that a maxim of 30 units per acre are allowed for HDR with 1.5 parking stalls; HDR2 would allow 42 units per acre for one bedroom and 36 units per acre for two bedroom units; Either zone.allows 1.5 parking stalls per unit. 1 It is a building department issue. Robert thinks that it is a zoning issue. Glenn made a motion to send this request back to the City Building Department for review. DaVawn seconded the motion. All voted aye. The motioned carried to remand the request back to the City Departments for review. Discussion on HDR2 Zoning John - BDR2 allows up to 42 single bedroom units per acre. BDR allows 30 units per acre. Discussion on the BDR2 Zoning and adding incremental jumps within the zoning, (i.e.) 26 -30 units, 30 -34 units, etc. The height limitations for HDR and HDR2 are three stories, which would require sprinklers. The City of Rexburg is limited to 2.5 story firefighting capability. Parking spaces drive the number of units per acre. Winston Proposed to add this Discussion to the 26' of June P &Z meeting for further discussion. Kent Archibald - Discussion on extending office space 1 V.` 22 feet Kent review his proposal on an overhead screen. There was discussion on the street and what options were available for the office expansion. Expansion to the South would not meet setback requirements. Eastward expansion would be subject to City Departmental approvals. Discussion of Eaglewood Subdivision Plat - Ted White Ted declared a conflict of interest and left the table. Ted. gave an explanation for a different subdivision plat option without adding property at the end of Yale Ave. This would change three lots and add a walking path. Ted offered an official proposal to go to City Council with this change to the plat. There was discussion on changing the original approved plat. John didn't have any problem going with this plat. Doug Smith made a motion to accept this plat as the final plat to go to City Council. The motion was seconded by DaVawn. All voted aye. Ted abstained. The motion carried. Discussion changing zoning on the Erickson Pontiac Property to HDR Discussion concerning changing the zoning from BBD to HDR. There are apartments on three sides of the old dealership. Even though construction of Dr. Archibald's expansion project is already under way, thank you for holding this official site plan review to ensure this project complies with the regulations outlined in the City of Rexburg Zoning Ordinance. As residents of the neighborhood that surrounds Professional Plaza, we are very concerned about both the setback of this building, and also adequate parking around the building. Setbacks According to the Rexburg Zoning Ordinance, the desired setback of a building in the underlying LDR -1 residential area is 25 feet. However, Section 4.9 of the Zoning Ordinance allows for an exception to the setback requirement. It states: "When fifty percent (50 %) or more of the lots on the same side of the street have been built, all buildings erected, established, or rebuilt shall be in conformity with the average setback of such buildings." While we did not know exactly where the property lines were located, we recently measured the setbacks of the buildings along the west side of Harvard Avenue (Professional Plaza) from Dr. Heiner's office on the north end of the block to Dr. Archibald's office on the south end. These measurements were from the sidewalk to the building wall. Here is what we found: Dr. Archibald (existing) Dr. Smith Dr. Merrell Targhee Medical Dr. Heiner AVERAGE 17 feet 5 inches 27 feet 4 inches 8 feet 8 inches 15 feet 8 inches (Measured from mid section) 82 feet 30 feet AVERAGE WITH DR. HEINER AT 25 FT 18.8 feet Dr. Archibald's new addition is set back only 7 feet 5 inches from the sidewalk. This is LESS than any other building on the west side of the street. We also believe that it is absolutely essential that Dr. Heiner's office be included in this average. His office is located on the north end of the same block and exemplifies a building that complies with the proper setback of 25 feet as desired in the Zoning Ordinance. Page 1 of 2 Property Deeded Back to Owners While researching this issue, we came across City Ordinance 824 approved in 1999 that deeded back property from the street to property owners on the west side of the street. We assume this triangular piece of property also was included in any setback calculations done by the city. (See Attachment). Parking We are very concerned about proper parking in front of this building, and in Professional Plaza in general. It is important that before additional construction is allowed in Professional Plaza that this issue be addressed. While visiting Dr. Archibald's office about two years ago, we had a discussion with an employee of his office who told us that parking was already a problem. Patients coming to this office wish to park next to the office, not in some space on the other side of Professional Plaza. Conclusion We love our residential neighborhood and wish to protect it from further encroachment from commercial development. We depend upon your commission to help us in this effort. As stated in the Zoning Ordinance, it is your commission's duty to "minimize the potential nuisance activities of offices in the residential neighborhoods." (Section 3.9) Therefore, if after careful consideration of all the facts, you find that Dr. Archibald's expansion project is out of compliance with any of the current city ordinances, he should be told to make the necessary adjustments to bring his office building into compliance. The only way to protect the surrounding neighborhood is to enforce the laws as they currently stand. Thank you for seriously studying this issue on our behalf.
