NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning and
Zoning Commission of the City of Rexburg, Idaho, Thursday, December 02, 2004, at 7:15 p.m.,
in the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding
a Conditional Use Permit (CUP) for a new sign representing the Toyota brand image. The
location is zoned as Highway Business District (HBD).
The said property is located at 615 South Yellowstone Highway in Rexburg, Madison County,
Idaho.
At such hearing the Planning and Zoning Commission will hear all persons and all objections
and recommendations relative to such proposed permit. The City Clerk will also accept written
comments at City Hall prior to 4:00 p.m. on December 01, 2004.
This notice is given pursuant to the provisions of Section 67 -6509 and 67 -6511 Idaho Code, and
all amendments thereof

Notice will state the conditions of the permit. If conditions are violated or not met there
will be a 94 day period to cure the problem. Failure to comply with the terms may result
in revocation of the Conditional Use Permit

Stones Sign
1) The sign I looked over was 8' x 24'
2) It looks like the new cup sign I have't seen is 30' x 10'
3) The sign code doesn't allow over 24' high for a sign unless
Building is over that height with cup. The sign code doesn't allow for a 300 sq. ft. sign
either (max. 200 sq. ft.)
4) the 8'x24' sign is 192 sq. ft. approx. wich is within the max of 200 sq. ft.
however the lot is under 50,000 sq. ft. the sign is on and is only allowed a 80 sq. ft.
sign.
5) the existing sign is 40' high and 4'- 2 -1/2" x 17' or 71.5 sq. ft. approx. in area
6) other points of concern is new sign can block traffic if not back at least 15' from
top back of curb, even if out of right of way.
7) The new sign whatever is approved will need wet stamped engineering drawings
8) According to sign code a free standing signs area is calculated by the wind load of
the sign not the advertising area if way smaller than the cabinet.
Kurt when considering a CUP for this sign consider these important points
Stones Sign

3) The sign code doesn't allow over 24' high for a sign unless
building is over that height and then it requires a CUP to be allowed to go the height of
the building. (building is not over 24' high) (You can keep in mind that the existing sign
is 40' high and the new sign is only 30' or 24' high depending on the sign the present for
a CUP. (keep in mind that whatever the reason you allow this sign to go higher than 24'
will be grounds for other CUP signs to follow) (Therefore if you allow the sign to be 30'
high because the old sign was 40' high then anyone who had an old sign like Mcdonalds
@ 120'? or whatever it is and wants a new one at only 90' will be given CUP because it
is way lower and an improvement? ) The sign code doesn't allow for a 300 sq. ft. sign
period. The max. allowed for any sign is 200 sq. ft.) never seen anyone be over that even
with a CUP.

CONDITIONAL USE PERMIT PROCEDURES
The City of Rexburg Zoning Ordinance designates certain land uses in each Zoning District
which are allowed. These are listed in the Zoning Ordinance for each zone. The City Clerk or
City engineer should be consulted if you have questions about whether your proposal will need a
Conditional Use Permit.
If a C.U.P. is needed, you will need to get an application from the City Clerk and fill it out for a
C.U.P. You will then need to return the application and request that the City Clerk put you on
the Planning Commission agenda one week prior to the meeting. The Planning & Zoning
Meetings are held on the 2n and 4' Wednesday of every month at 7:00 p.m.
The City Clerk will then mail to the Planning Commission the application for them to review
prior to the meeting. At the meeting the board will discuss your request with you and set it for
Public Hearing. You will need to pay the City Clerk.prior to any advertising for the
hearing. Prior to granting a conditional useast one Public Hearing shall be held to give
persons an opportunity to be heard.
The City Clerk will put the notice for the hearing in the paper 15 days prior to each hearing, mail
a copy to all the property owners within 300 feet and post a notice on the property. After the
Planning Board holds their hearing they will make a recommendation to the City Council. The
City Council will take the Planning Board recommendation into consideration. If a hearing is
required before the City Council they will then take into consideration oral and written
testimony as well as the recommendation from the Planning Board. A decision will be made by
the City Council within the time frame allowed by Section 67 -6511, Idaho Code.
