system miscalculated fees for a short period of time.
During that time, you were issued a building permit. Therefore, the fees were
miscalculated. An invoice is enclosed showing the amount you were undercharged.
Please review this information and call if you have any questions. Payments can be
made at City Hall.
We apologize for any inconvenience this has caused. The calculations have been
adjusted to ensure this problem will not happen in the future.

I, Val Christensen, state and declare the following under oath:
1. I am the Building Official for the city of Rexburg.
2. A copy of the SITE PLAN for Joe's Filling Station was submitted to the city
of Rexburg on August 24, 2004.

4. The SITE PLAN does not show that the insulated storage building in this
case is located on the right of way of the Eastern Idaho Railroad; moreover, the SITE
PLAN does not show that the electrical connection for the insulated storage building,
part of the area for "landscaping and snow storage," part of the pavement, and the
parking spaces for the Defendants' employees are also located on the right of way of
the Eastern Idaho Railroad.
5. The Defendants did not notify or otherwise inform the city of Rexburg that
the insulated storage building is located on the right of way of the Eastern Idaho
Railroad; moreover, the Defendants did not notify or otherwise inform the city of
Rexburg that the electrical connection for the insulated storage building, part of the area
for "landscaping and snow storage," part of the pavement, and the parking spaces for
the Defendants' employees are also located on the right of way of the Eastern Idaho
Railroad.
6. The city of Rexburg has duly adopted the International Building Code.
See ORDINANCE NO. 932.
7. Section 105.1 of the IBC states, in pertinent part, the following:
Any owner or authorized agent who intends to construct ... any
building or structure ... shall first make application to the building official
and obtain the required permit.

8. The city of Rexburg does not require a building permit if the building or
structure does not exceed 120 square feet; otherwise, the "owner or authorized agent"
must have a building permit:
... Permits shall not be required for the following:
1. One -story detached accessory structures used
as tool and storage sheds, playhouses, and
similar uses, provided the floor area does not
exceed 120 square feet.
See IBC, Section 105.2.
9. With respect to the insulated storage building in this case, please note that
the Defendants did not receive a building permit for the insulated storage building from
the city of Rexburg.
10. Section 106.2 of the IBC states, in pertinent part, the following:
The construction documents submitted with the application for
permit shall be accompanied by a site plan showing, to scale, the size and
location of new construction .... distances from lot lines.... and it shall
be drawn in accordance with an accurate boundary line survey.
11. Again, the SITE PLAN in this case does not show that the insulated
storage building is located on the right of way of the Eastern Idaho Railroad; moreover,
the SITE PLAN does not show that the electrical connection for the insulated storage
building, part of the area for "landscaping and snow storage," part of the pavement, and
the parking spaces for the Defendants' employees are also located on the right of way
of the Eastern Idaho Railroad.
12. Finally, Section 113.1 of the IBC states the following:
It shall be unlawful for any person, firm, or corporation to erect,
construct, . . . move, . . . or occupy any building [or] structure . . . in
violation of any of the provisions of this code.

These plans have been reviewed for compliance to the IBC. The purpose of the IBC (and thus the
review) is to "establish the minimum requirements to safeguard the public health, safety and general
welfare" (IBC Section 101.3).
This stamped and signed set of plans must be "kept at the site of work and shall be open to

Big O Tires was only charged this much because the business that was there before them had already paid the
connection fees. They are using less water than the previous building. All is okay. Joe's Filling Station should
have paid water and sewer connection fees. Could you please research weather they are on the system
accounts? Please let me know-John M.

Hi John,
I am turning in the outstanding impact fees to Blair so he can collect on them. I have a question about the water
and sewer hookup fees for Big O Tires and Joe's Filling Station. Joe's Filling Station wasn't charged any hookup
fees. Do you know why there wouldn't have been a hookup fee charged? Should I go ahead and charge him the
hookup fees? Also, Big O Tires was charged $514 for sewer front footage and $514 for water front footage but no
hookup fees. Do I need to charge them for a hookup fee or was that included?
I know you will be busy coming back from your trip so whenever you have a minute to call or come over would be
fine.
