Hill and Jeanette Hill, husband and wife, that Merrill Rudd is making plans to build some structures on land which he owns west of North l s` East North of 2nd North. My clients are concerned that the placement of any buildings on the South one -half of Lot 1, Block 15, would interfere with a recorded easement which they have for ingress and egress over the. existing road right -of -way which lies over the South half of Lot 1, Block 15, in the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof and also the land contained in the legal description to their deed, a copy of which is attached as Exhibit 1. This easement extends approximately 45 feet north of the property owned by the Mays and runs west to the property owned by M -CO, Inc., an Idaho corporation, and then extends south of M -CO Inc.'s, property to the property presently owned by Dirk Richards. The Hills, Mays, M -CO and Richards, and their predecessors in interest, have continuously used this easement for access to their properties for over twenty -five years. Since large transport trucks with trailers and 40' trailers with machinery and equipment access this property and utilize approximately 45' north of the Mays' property and the entire area to the west of the May property and to the south of M -CO's property to turn around, deliver products and also to pick up recyclable paper products, these individuals and entities do not want anyone to put any structures on any of the easements which they have used and which they and their suppliers need to access their respective parcels of land. Copies of the deeds to the Mays, M -CO, Inc., and Richards are attached as Exhibits 2, 3 and 4. Each of the deeds preserve the easement for ingress and egress over the existing road right -of -way which is used on a daily basis. a City of Rexburg Building Department May 13, 2002 Page Two Therefore we would request that the City Building Department do not issue any building permits to Mr. Rudd which would any way infringe upon these existing easements. The site plan does not show an easement on the West side. It has come to my attention that the City of Rexburg is going to provide that easement. Please get with the party who offered the easement and provide me with a recorded copy. I have red -lined the site plan to show a 20' wide easement and a 10' set -back at the back ofthe building from property line. 2. Our frost depth is 36 ". The plans identify the foundation to be constructed at 30" below grade. I have red - lined the plans to show a 36" minimum depth. The structural notes on page SO.1 identify that the foundation design was performed using the UBC. The design must be based on the 2000 International Building Code (IBC). Please provide the necessary information from your engineer to clear up these problems. 3. The State of Idaho has adopted the 2000 International Energy Conservation Code.
