BEGINNING.

The intended use of the Everett Place Condominiums will not change from its current use
as residential housing. Ownership will change such that the individual units within the
four -plex may be owned separately.

I am in receipt of your letter dated February 23, 2009. In that letter, you
indicated that we needed to record our plat with Madison County for Everett Place
Condominiums by April 15, 2009. Please recognize, by the enclosed documents, that our
plat was filed and recorded on March 12, 2009. As per your request, we have enclosed
the one inch equals three hundred feet scaled map of the project. That sized copy of the
plat is likely not usable by the City of Rexburg. Please contact me if we may provide
other information that you can use that would be responsive to your request.

Dear Mr. Scott:
Your application for Final Plat approval for Everett Place Condominiums was granted at the
Rexburg City Council meeting held on October 15, 2008. It is our understanding that this plat has yet
to be recorded with Madison County.
The Sub - Division Ordinance for the City of Rexburg states that " The final plat shall be filed with
the County Recorder within six (6) months after approval by the Council; otherwise such approval
shall become null and void unless an extension of time is applied for and granted."
If your intention is to ultimately record this plat, please submit a written request for extension to the
City. This request will go before the Planning and Zoning Commission and the City Council for
review and approval. Please submit your request for extension by March 31, 2009. If we have not
received your request by that date, it will be our understanding that you do not wish to proceed with
this project. If you then wish to pursue this project in the future, we will be happy to assist you with
the application process.

Final Plat
1. On August 21, 2008, Kristopher Meek of Hopkins Roden Crockett Hansen & Hoopes,
representing applicant Carlon Scott, presented to the Rexburg Planning & Zoning
Coordinator a Request and Application for a Final Plat for Everett Place Condominiums
2. On September 4, 2008, Kristopher Meek, representing the applicant, presented to the
Rexburg Planning & Zoning Commission the Request for approval of the Final Plat for
Everett Place Condominiums.
Mary Ann Mounts motioned to recommend approval to City Council for the final plat for
Everett Place Condominiums, 887 Everett Place, to include the condition to repair the
damaged sidewalk at the front of the property ( note from staff: This condition would be in
addition to those placed on the preliminary plat approval). Dan Hanna seconded the
motion. None opposed. Motion carried.
3. On October 15, 2008 Kristopher Meek from Hopkins Roden Crockett Hansen & Hoopes
at 428 Park Avenue in Idaho Falls presented a plan for approval of an apartment building
transitioning to condominiums. Planning and Zoning was concerned with the sidewalk
which has been replaced. The other issue was the need to install three trees in the front of
the property and some trees in the back of the property. New owners have to agree to abide
by the CCR's for the development.
City Attorney Zollinger said everything was in order with the CCR's.
Council Member Woodland asked if there was adequate parking. Mr. Meek said the parking lot was
reallocated to cover the required parking for this development.
Council Member Bart Stevens move to approve the Final Plat for Everett Place Condominiums; Council
Member Erickson seconded the motion; all voted aye, none opposed. The motion carried.
