On August 5, 2008, Stan Rowlan of Westates Construction, presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Conditional Use Permit for construction of a 132 unit apartment complex consisting of five buildings with 24 units and one building with 12 units, located at approximately 568 Pioneer Road. 2. On August 5, 2008, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for August 7, 2008, and August 16, 2008. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. On August 21, 2008, Stan Rowlan presented to the Planning & Zoning Commission for the City of Rexburg the Request for a Conditional Use Permit for the apartment complex as described above in paragraph one. David Stein motioned to recommend to City Council to grant the Conditional Use Permit for Stonebrook Apartments Phase 2, with the condition that the standards in Section 6.13 for Conditional Use Permits (Development 'Code 926) are met, to include the condition that the developer work with City staff to mitigate glare to neighboring properties, the condition that the developer work with City staff to meet all parking concerns, and the condition to include buffering from neighboring properties to the west and to the south of the development by using the same kind of buffer used in Stonebrook Apartments Phase 1 (a 2 foot berm with a 6 foot fence on top of the berm). Dan Hanna seconded the motion. None opposed. Motion carried. 4. On September 03, 2008 at City Council Stan Rowland reviewed the proposal for 132 units on the overhead screen. He is requesting a Condition Use permit for larger buildings. It is the second phase of an existing project located at 600 Pioneer Road. These buildings will contain 24 units with fire safety sprinkling. Council Member Mann was concerned with the parking on the street instead of in the development. Council Member Erickson reviewed the Planning and Zoning conditions for approval and agreed it was decided parking was adequate. Planning and Zoning Administrator Leikness said the Planning Commission said to work with staff; maybe trees or shrubs could be planted to mitigate cars lights shining into opposing buildings. 5. Council Member Erickson moved to approve Stonebrook Apartments Phase 2 with staff and Planning and Zoning conditions. Council Member Stevens seconded the motion. All voted aye, none opposed. The motion carried. NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning & Zoning Commission of the City of Rexburg, Idaho, Thursday, August 21, 2008, at 7:05 p.m., in the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a Conditional Use Permit for the construction of 132 unit apartment complex consisting of five buildings with 24 units and one building consisting of 12 units located at 568 Pioneer Road. The current HDRI Zone allows 30 dwelling units per acre by right. Any buildings with 24 units or greater require a "Conditional Use Permit." The said parcel is located at 568 Pioneer Road in Rexburg, Madison County, Idaho, and more particularly described as follows: Block 1, Lot 3 of Westates Subdivision #1. At such hearing the Planning & Zoning Commission will hear all persons and all objections and recommendations relative to such proposed permit. The City Clerk will also accept written comments at City Hall prior to 4:00 p.m. on August 20 2008.
