On June 25, 2008 Kurt Roland of Schiess &Associates, representing Curtis Ferney, presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Final Plat for Pinebrook Estates Division 2. 2. On August 7, Kurt Roland presented to the Rexburg Planning & Zoning Commission the Request for approval of the Final Plat for Pinebrook Estates Division 2. Dan Hanna motioned to recommend approval to City Council of the final plat for Pinebrook Estates Division 2, with the condition that all lots fronting 12'' West will have no access onto 12 West, and requiring that the Development Agreement with the city be in place prior to the final signing of the plat. Ted Hill seconded the motion. There was a brief discussion with John Millar on the proposed development's water and sewer lines, which will be formally addressed in their Development Agreement with the city. None opposed. Motion carried. 3. Council Member Stevens asked about street widths: 68 foot wide streets and 100 foot cul -de -sacs. Mayor Larsen reviewed the berm across the front of the development. He asked about fencing. There will not be any fencing along 12`'' West; however, some fencing applications make sense. Curtis Ferney said the berm along 12`'' West would be better than a fence if it is done correctly. Mayor Larsen asked if fencing was a requirement in the city's subdivision ordinance. In some applications it would really make sense. Public Works Director Millar was not aware of a fencing requirement. Council Member Stevens indicated a berm would look very nice if done correctly. Council Member Stevens moved to accept Pinebrook Estates Division 2 Final Plat; Council Member Schwendiman seconded the motion; Discussion: Planning And Zoning Administrator Leikness requested adding: subject to the conditions recommended from Planning and Zoning (with the condition that all lots fronting 12' West will have no access onto 12` West, and requiring that the Development Agreement with the city be in place prior to the final signing of the plat) and Council Member Stevens said it would be noted on the plat. Curtis Ferney added it would be noted on the plat plus CCR's and bylaws would be noted on the plat; Council Member Stout asked if the berms and development agreement would be documented? Public Works Director Millar said the location of the berm will be noted on the plat. The structural requirements and payment method for the berm will be in the development agreement. 12` West access restrictions would be in the development agreement. All voted aye, none opposed. Your project meets the terms and conditions of our Nationwide Permit Program at 33 CFR 330, Appendix A. Before we can authorize your project, you will need to obtain water quality certification or waiver of certification from the Idaho Department of Environmental Quality. To help you through the certification process, we sent a letter to the Idaho Falls office of IDEQ, asking them to consider water quality certification for your project. We also asked them to notify you of their decision. If you do not receive their response by January 4, 2008, you may assume that water quality certification has been waived. If IDEQ denies water quality certification, your application for permit will be denied and you may not construct the project. You may check on the status of DEQ's water quality certification by contacting Mr. Troy Saffle at (208) 528 -2650. If IDEQ issues water quality certification or waiver of certification, your project will be authorized under Department of the Army Nationwide Permits 12 (Utility Line Activities) and 33 (Temporary Construction, Access and Dewatering) (33 CFR 330, Appendix A) and you may proceed with construction as shown on the drawings enclosed with your August 27, 2008, Joint Application for Permits and November 3, 2008, Addendum, subject to the conditions of the water quality certification, the terms and conditions of the enclosed nationwide permit, and the special conditions listed below. If you cannot meet these conditions, or if you change the project described in your permit application, this nationwide permit verification letter is not valid. a. Fish passage shall be maintained during project construction. b. Cofferdam material shall be removed from the channel, upon completion of the project, and deposited in an upland location where it will not reenter a water of the United States. Equipment may not be stored below the ordinary high water mark overnight or for extended periods, to reduce the potential for accidental release of fuels or lubricants. d. Equipment operated below the ordinary high water mark must be free of fuel and lubricant leaks, to reduce the potential for accidental release of fuels or lubricants. e. Remove equipment and machinery from the waterway, to an upland location prior to refueling, repair or maintenance. f. Silt fencing or other erosion and sedimentation control device shall be installed between any area of earth disturbance and the South Fork of the Teton River and adjacent wetlands and left in place throughout construction. The silt fencing must be installed according to the manufacturer's specifications, during construction, and must be maintained until the construction activity is completed and the disturbed ground is re- vegetated and stable, to prevent erosion and the release of sediments downstream. g. In -water work shall be accomplished during periods of low flow to reduce turbidity. If project results in visible turbidity, sediment control devices shall be installed to control turbidity during construction. h. Re- vegetate all areas disturbed by project construction with native species immediately upon completion of the project, to protect them from erosion. Revegetation shall include planting native woody species adjacent to the stream. i. The wetland boundaries shall be clearly marked with flagging or fencing prior to construction. No fill material shall be placed in wetlands unless the wetland fill is specifically authorized and shown on the permit drawings. j. Permittee is responsible for all work done by any contractor. Permittee shall ensure any contractor who performs the work is informed of and follows all the terms and conditions of this authorization (including any special conditions listed above). Permittee shall also ensure these terms and conditions are incorporated into engineering plans and contract specifications. k. Permittee shall notify James Joyner at 208 -522 -1676 when construction begins. Permittee shall sign and return the enclosed Compliance Certification when the project is completed. This verification is valid for 2 years from the date of this letter, unless the NWP is modified, suspended or revoked. In addition, if you start or are under contract to start this activity before this date, you may have another year to complete the activity under the present terms and conditions of this nationwide permit. This determination applies only to Department of the Army permits administered by the Corps of Engineers. Your project may also require permits from other Federal, state, and local agencies. If your work requires a permit from the Idaho Department of Water Resources, you will need to obtain their approval before starting work. You should also contact your local city or county zoning office for any permits they may require for your project. 0 0 -3- We have not prepared, and this letter does not constitute, an approved jurisdictional determination for your project. There are now no posted green spaces in the entire large sub - division. I have attended all the hearings as have many neighbors in our community. In the public hearing process, a park along with 2 other green spaces was promised and pointed out where they would be placed and were actually there on the overhead as part of the approval process. On the posted plat at the entrance of Larch Dr., none of these green spaces are shown, including the large park in the Southeast corner. The second unfulfilled obligation is that the road connecting Larch Dr. and the cul -de -sac of the large public park was to be for city emergency vehicles and was agreed to be put in but narrow and unpaved. It is now a normal size, paved road that will allow complete access through the existing Pine Brook Subdivision 1. At numerous times, Mr. Furney has made promises to the residents of the Hibbard area, but then presented a different zoning or density proposal at the next public meeting. On all occasions, the city has held Mr. Furney to his promises made to the members of Hibbard, but especially to the 5 families who voluntarily annexed based on these promises. That Mr. Furney would flout the publicly approved site plan after so much controversy regarding the green space and connecting roads, shows his utter disregard for the public hearing process. He must know that the city will not allow him to sell off the required green space as housing lots. I wanted to let the city council know that this is happening, before the lots are sold and it becomes even more complicated. We were told from the council, that this particular subdivision will be watched and made sure that it follows every code and promise. Please, we would appreciate it if you would look into this lack of compliance. A green magic marker should do the trick.
