Dear SE /Z Construction:
You have requested an occupancy permit for 1120 Stocks Ave. At this time it appears all
requirements have not been met for the issuance of a Final Occupancy Permit. However, it has
been determined by the Building Department that a conditional occupancy permit may be granted
with the following requirements being met.
1) Trash enclosure needs to be installed.
2) Any site plan items not complete due to inclement weather need to be completed.
A temporary occupancy permit will be issued until 6/1/2009 at which time the above requirements
need to be completed.
Upon completion of the above requirements, please call the City of Rexburg Building Department at
(208) 359 - 3020 extension 326. An inspector will be sent out and a Final Occupancy Permit will be
issued.

I have released the hold from Planning and Zoning. Work with JaNell to see when your approved permit will
be ready for pick -up.
Just as a reminder, please submit a statement (this can be an e-mail or a letter) that you will work with the
Public Works Department and /or the City Council on the perimeter sidewalk issue prior to the issuance of a
final certificate of occupancy. That should give you plenty of time to find out if the City sidewalk is required
at this time or for some other date, and not hold you up on obtaining your building permit. Your letter
regarding this issue will allow me to stamp your site plan approved.
As for landscaping, please submit the landscape plan for review and approval as soon as you can, but no later
than before requesting a final inspection. I will need to review it to see if it meets the intent of the ordinance
and to insure that no plantings will be located in "clear vision" areas for traffic safety.
Regarding the requirement for "community features" or Enhancements as you refer below, this is a
requirement for your type of development. This can be as simple as a flag pole with rocks and landscaping
around it, and a park bench in another area. The intent of this ordinance is to create interesting places for
the public. Look at the seating areas in front of Walgreens, that is how they satisfied this requirement, and is
a fairly decent example. If you show on your landscaping plan on what you propose, that should suffice. I
signed off on this requirement in our system with the note that you would address this with your landscape
plan.

JaNell / Gary: Pursuant to the attached excerpt from the Building Permit Review comments
dated June 10, 2008: we provide the following comments.
-1- Perimeter sidewalks: The proposed construction location is within Phase I of the Industrial
Park. At the time this development was constructed, perimeter sidewalks were not required.
Thus, this should not be made a requirement now. This new construction should be
"grandfathered" under the old requirements.
-2- Building fagade (south elevation): We propose that the fact we have a canopy with columns
at this southern elevation satisfies the requirement noted. Please consider this in your review.
-3- Enhancements: We do not see where this requirement comes into play in this location since
this area was developed under Phase I requirements. As noted above, pedestrian sidewalks
were not required under Phase I. The review comment states that "Any such areas shall have
direct access to the public sidewalk network... ". Since no public sidewalks were required under
Phase I, there would be no enhancement requirement since there are no sidewalks to tie into.
Please reconsider the review comment in this light.
If we must meet with the Reviewer to discuss these in person in an effort to resolve these
items, we are very willing to do. Let us know a time and date; and we will be there.
