Date of Recording January 11, 2005 PURPOSE OF COVENANT The City of Rexburg Zoning Ordinance provides for minim lot area, lot coverage, lot width, lot depth, and /or structure setbacks from property lines for any development on a lot. Owner desires to have multiple legal lots owned by Owner, which comprise the Property described above, treated as a single lot for the purposes of applying these and any other applicable Zoning Ordinance provisions to Owner's proposed development. The City is willing to allow Owner to treat the property as a single lot for those purposes, provided Owner covenants as provided herein. Box 280 Rexburg, Idaho 83440 Dear Mr. Leikness: Our sincere thanks to the Building Department, the Fire Department, and Public Works Department, as well as the Planning and Zoning Department, for your review and comments on the Upper Valley Industries project. We would like to address three issues from those reviews: a Restrictive Lot Line Covenant, parking, and utilization of the kitchen within the classroom and administrative building. With regard to the Restrictive Lot Line Covenant, please find the completed form as provided by Elaine. If you have any questions regarding this form and /or any of the backup information provided, please feel free to contact me at your earliest convenience. Upper Valley Industries presents a unique parking requirement associated with its facilities. Of the 35 to 40 individuals with disabilities that report to Upper Valley Industries for training and employment each day, only 6 or 7 drive their own vehicles. The balance of our clients are delivered to Upper Valley Industries by parents or transportation providers. Currently, there are six different transportation providers that will drop off and pick up the clients each day. We employ 20 staff and the majority of the staff members drive their own vehicle. Additionally, Gary, there are about 8 corporate vehicles that will be parked in the back of the building or at the north end of the building with adequate distance away from the building to provide access for fire- fighting vehicles and other emergency vehicles. The kitchen facility in our classroom and administrative building is used as a teaching station. Individuals and small groups, no more than 4 or 5 individuals, will be taught basic cooking skills. The kitchen will be utilized for individual and small group instruction. Individuals who attend Upper Valley Industries for training are instructed to bring a cold lunch or food that can be heated in one of several microwaves provided in the new facility.
