Thank you for the opportunity to submit this preliminary plat application for the proposed Riverwood
Townhomes Division #3. Enclosed, please find a complete preliminary plat application for the subject
project.
We have made every attempt to address the items that came up during our pre - application conference
on December 18, 2007. In addition to the items we have submitted as part of this application, please
note that we are also willing to stipulate to submitting a completed "Restrictive Lot Line Covenant
Application ", to allow zero setback along our eastern boundary, as part of the final plat application. We
are proposing this based on your suggestion and guidance on this issue at the pre - application meeting.
If there is any additional information we can provide or if there are any questions we can answer, please

Dear Mr. Leikness
We appreciate working with you and understand the need to maintain codes in association with
building and development standards. You brought to our attention that the garbage dumpsters at
Riverwoods Townhomes Division II have not been enclosed with the approved material. The
current dumpster site is only temporary.
Jenks Brothers Inca is in the process of rezoning the adjoining property to the west of
Riverwoods Townhomes Division II. This will be Riverwoods Townhomes Division III.
Included in this third division is the final garbage dumpster area that will be equipped with the
approved enclosure material.
This letter is intended as an agreement between the developer, Jenks Brothers Inc, and the City
of Rexburg. The agreement is that the City of Rexburg will grant final occupancy permits on all
Riverwoods Townhomes Division II properties with the temporary dumpsters in place. Jenks
Brothers Inc. agrees to the placement of enclosed dumpsters on'the Riverwoods Townhomes
Division III property before any occupancy permits are issued for Riverwoods Townhomes
Division III.

Riverwoods Townhomes Division 3 — Preliminary Plat
1. On February 4, 2008, Jenks Brothers and HBH Engineers presented to the Rexburg Planning & Zoning
Coordinator a Request and Application for a Preliminary Plat for Riverwoods Townhomes Division 3.
2. On February 21, 2008, Mike Arneson of HBH Engineers, representing Jenks Brothers, presented to the
Rexburg Planning & Zoning Commission the Request for approval of the Preliminary Plat for Riverwoods
Townhomes Division 3.
Dan Hanna motioned to recommend for approval to City Council the Preliminary Plat for Riverwoods
Townhomes Division 3. Thaine Robinson seconded the motion. None opposed. Motion carried.
3. On March 05, 2008 the Preliminary Plat for Riverwoods Townhomes Division No. 3 was reviewed at
City Council: Michael Arneson, PE with HBH Consulting Engineers at 1970 East 17` Street in Idaho
Falls representing the Jenks Brothers. This is an addition to existing units. The property is zoned
correctly. They are identical architecture to existing units. They have met with the Planning and Zoning
Department to make sure they are in conformance with city code. Each unit will have a double garage
in the back of the units plus 14 parking stalls in the rear of the development. Council Member Stout
asked about the staff concerns. Concern 1: location of the trash receptacle away from frontage.
Concern 2: Architecture is applicable to other units. Concern 3: easements for sidewalks. Concern 4:
sidewalk leading into the development from exterior sidewalk. Concern 5: Build to current standards.
Concern 6: Street name change. Concern 7: Fire Department asked to increase the entrance width from
14 to 20 feet.
Council Member Stevens moved to approve the Preliminary Plat for Riverwoods Townhomes
Division No. 3; Council Member Woodland seconded the motion; all voted aye, none opposed.
The motion carried.
