the requirements under the zoning ordinance.
1. What is the estimated water usage per month? Are the existing mains adequate to provide fire protection?

The Commission or Council may address other points than those discussed above, but a narrative addressing at
least those applicable points will assist in processing your application. A PLOT PLAN MUST BE ATTACHED IN
ORDER TO PROCESS THIS APPLICATION. Included on the plot plan setbacks, parking, etc.
Formal notice will be sent to applicant after approval of a Conditional Use Permit. Notice will state the conditions
of the permit. If conditions are violated or not met there will be 90 day period to cure the problem. Failure to
comply with the terms may result in revocation of the Conditional Use Permit.

It is my intention to open a preschool out of my home. I will be the only employee of the preschool and the
only one working with the children. It is my intention to work with ten to twelve children at one time. I will
not have more than twelve children between the ages of three and five at one time. These children will be
from the local community and from my neighborhood. They will attend school for two and a half hours a day,
Monday thru Thursday, at which time their parents will drop off and pick up their children. Some of the
children will be from my neighborhood and will be walking to school, others will be carpooling. Thus, cutting
down on the amount of cars in the area. I will not be putting signs up anywhere on my premises, as this will be
a word of mouth preschool.
I am a certified Idaho teacher and wanted to utilize the teaching tools in my basement and thought, why not
offer a preschool that is so badly needed in this area. Please feel free to contact me with any other questions or

1. The life safety requirements for this particular use must be met.
2. The owner is the only employee approved at this time. If additional employees are needed in the future, the applicant
must present to the Planning & Zoning Commission a proposal for review.
3. A business license must be obtained for the preschool.
4. In order to minimize the potential for vehicle /vehicle and vehicle /pedestrian conflicts, loading and unloading (pick -up
and drop -off) of students shall be limited to the public right -of -way, not the driveway. This requirement shall be stated
on any contracts signed by clients and verbally stated. On -going enforcement shall be the applicant's responsibility..

Conditional Use Permit
1. On October 9, 2007, Niccola Tavares presented to the Rexburg Planning & Zoning
Coordinator a Request and Application for a Conditional Use Permit for a preschool located
at 374 Oaktrail Drive.
2. On October 10, 2007, the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper for October 17, 2007, and October 27, 2007. A notice was posted on
the property and sent to all property owners within 300 feet of the above mentioned
property.
3. On November 1, 2007, Niccola Tavares presented to the Planning & Zoning Commission
for the City of Rexburg his Request for a Conditional Use Permit for a preschool located at
374 Oaktrail Drive.
Mary Ann Mounts motioned to approve the conditional use permit for a preschool at 374
Oaktrail Drive, with the conditions that she contract with the parents that they drop their
kids off along the road, and not use the driveway so they don't have to back out, that she
meet the life safety requirements for the state or city for this particular use, and that she gets
a business license. She is not approved for any additional employees. If she needs to get
more employees, she must come back to the Commission for further review. David Stein
seconded the motion.
None opposed. Motion carried.

NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the Planning & Zoning
Commission of the City of Rexburg, Idaho, Thursday, November 01, 2007, at 7:05 p.m., in the City
Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a Conditional
Use Permit for a Preschool at 374 Oaktrail Drive, Rexburg, Idaho. The property is currently zoned
Low Density Residential Two (LDR2).
The city code governing this request is ORDINANCE No. 926
"DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO"
(ADOPTED FEBRUARY 16th, 2005) and Amended 7/06/2005; 5/07/2007; 7/03/2007
The said parcel is located at 374 Oaktrail Drive in Rexburg, Madison County, Idaho, and more
particularly described as follows:
Lot 9 in Block 1 of Oakbrook Subdivision, Division No. 1, a replat of Lot 1, Block 4 of the
Westates Subdivision No. 1, an Addition of the City of Rexburg, Madison County, Idaho, as per the
recorded plat thereof.
At such hearing the Planning & Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed permit. The City Clerk will also accept written
comments at City Hall prior to 4:00 p.m. on October 31st, 2007.
This notice is given pursuant to the provisions of Section 67 -6509 and 67 -6511 Idaho Code, and all

Regarding the proposed Conditional Use Permit for a Preschool at 374 Oaktrail Dr.,
I am neither for nor against the plan. I need more information before I can make an
assessment. I do feel more information should be available regarding the proposed
conditional use permit..
My specific questions are:

• How many children maximum will be enrolled in the preschool
• What are the hours of operation?
• How many additional cars (for preschool employees) will be parked on the road?
• How many employees will you have?
• What is the duration of the conditional use permit? How will it be renewed?
• Will a safety or fire inspection of the business be required? How often?
I am unable to attend the meeting on Thursday but hoped you would consider these
questions and publish the answers.
