Final inspections have been completed for this project. The following items are those
that are outstanding and should be addressed in order to consider the project completed:
1) Required tree needs to be planted.
2) Tree grates need to be installed.
The Planning and Zoning Department would request that a temporary certificate of
occupancy be issued that is valid until June 9, 2008 in order for the development to
resolve the above stated issues.

Pursuant to the provisions of the International Building Code 2000, the undersigned requests that
a building permit be issued for:

Acknowledgment is made that the plans for the complex are not complete and that final approval
of the building will not be given until the final plans have been approved. We recognize that
proceeding with partial construction at this time is entirely at the risk of the Architect/Owner
with there being no assurance that the final Certificate of Occupancy for the entire building or
structure will be granted.
We further absolve the City of Rexburg and officers and employees thereof, of all resposibility

Dear Val,
Thank you for your review and comment on the permit application for the above mentioned
project. The following is in response to Plan Review Action on the permit review.
Building Department Review
1. Building is Type V -B, Occupancy M.
2. We have reviewed the existing openings at Bingham and Sons and will fill in the
existing openings.
Structural Review
1. See above comment regarding openings. The design for the new wall construction is
a two -hour rated concrete masonry unit construction. When the existing openings are
filled in the existing stone masonry wall will have a rating.
Public Works Review
I. We will take a 4" roof drain leader to the existing storm drain system located in
Center Street. Originally the existing storm drain was tied to the sanitary sewer
system and has been corrected at this point. We will need to saw -cut the existing
asphalt an intercept the existing line at the street and patch back the asphalt cut.
Site Plan Review
I. The drawings note a new two -hour separation wall at the west and south walls. This
is noted on the floor plan and on sheet A2.1. Please refer to the section and notes
which call for the separation wall. These walls are not holding any structure, they are
being constructed independent of the bearing walls for the roof.
I believe these responses take care of any outstanding responses needed. Please call if you need

As per our conversation earlier this week I have looked
into the matter of the North facing windows in your
building located at 16 S. Center. After further
investigation, I can't find a previous code that would have
allowed the windows as now configured. These windows must
be replaced with non - openable, fire rated assemblies, with
two layers of 5/8" Type X drywall or any other approved
method as allowed by the International Code Council (ICC).
The owners of the property to the North of this building
are in the process of requesting a building permit for a
new building that would be built to a height that would
cover these windows. I have attached a copy of that letter
to the back of this document. I am asking you to get with
these people and come to a decision concerning this matter.
On another matter, our Building Inspector Jon Berry met
with you concerning the apartment that is located in the
upper floor of your building. You discussed with him

Dear Hal,
After reviewing the Alpine Jewelers New Office Building
plans, there are a couple of issues that will need to be
addressed prior to us providing a building permit for the
project. As you and I discussed in our recent meeting, the
windows and the openings in the Bingham and Son's building
must be closed up as to obtain a fire rating as per the
requirements of the 2003 International Building Code. You
were going to meet with them and work out the details. I
have not heard back from you.
At our meeting I told you that I would contact the owner of
the building to the South of the project. I have done
that. The North wall of this building has two windows.
Today's code would not allow these windows, however earlier
codes would have allow rated windows. We have instructed
Mr. John Vanorman that he must replace the non - compliant
existing windows with those that would meet the code at the
time of the building's construction. The parapet on the

South end of your building appears to cover all or part of
the windows that exist in the North facing wall of Mr.
