On August 8, 2007, Dan Dummar presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Preliminary Plat for the Professional Plaza Modification Plat. 2. On September 6, 2007, Dan Dummar presented to the Rexburg Planning & Zoning Commission the Request for approval of the Preliminary Plat for the Professional Plaza Modification Plat. Mary Ann Mounts motioned to recommend to City Council to approve the preliminary plat for the Professional Plaza Modification Plat. Dan Hanna seconded the motion. Chairman Dyer abstained. None opposed. Motion carried. 3. Council Member Erickson asked about the 21 foot easement. Dr. Smith has built 5 feet into this easement. Mr. Dummar explained this easement still meets city code for emergency services, etc. City Attorney Stephen Zollinger explained this easement is not a safety easement, it is a utility easement. This has no effect except converting joint ownership into private ownership. This new plat will remedy existing problems with the current plat. Council Member Erickson moved to approve the preliminary plat for the modification of the professional plaza. Council Member Young seconded the motion. Council Member Schwendiman did not vote.
