Hopefully the meeting was useful for you by being able to sit down with all City inspectors and discuss final inspection findings for the Burton Elementary, soon to open for operation. During that meeting I offered information regarding my final inspection, which included a report on the architectural design standards that the school proposal was required to go through. It was determined that at the time of the meeting, there were items of the site and the building design that needed to be addressed in order for Planning and Zoning to sign a final Certificate of Occupancy (COfO). I distributed this list to you and others that were present at the Dec 1 meeting. I also put a copy in the City file. !, After this meeting, I reported back to the Design Review Committee (Dec 11, 2008), to let them know how the final inspection for P &Z went. The committee looked at what was proposed by your group and approved by the City. I took pictures of the building as it currently stands to help them understand what items were not addressed. They determined that the elements that were agreed upon through the Conditional Use Permit process, the site plan review process, landscape plan review process, and the architectural design review process need to be upheld. However, they were okay with the west side of the building not having the required 10 -foot landscape strip that was approved on the submitted site plan and landscape plan. See approved building elevations for design that was to be adhered to. 3) North wall does not include vertical brick elements as agreed upon with the DRC. See approved building elevations for design that was to be adhered to. 4) North wall does not screen roof top mechanical equipment. 5) No landscaping has been installed per approved landscape plan. 6) Dumpster location on north side of building needs to be screened with landscaping as well as material. 7) No irrigation plan was submitted. We still need to see how plants are to be irrigated and how areas outside of immediate school vicinity will be maintained. 8) The 10 -foot required landscape strip along walls not present. This was a negotiation point for the DRC, more landscaping, less worry about a long wall facing the public right -of -way. Landscaping, vertical brick elements, and glass windows were to be installed to buffer the long tall wall facing the public street (right -of- way).. 9) Deceleration striping along front of property to discourage diagonal parking. 10) Is the ADA access from public right -of -way to building too steep? It appears so. 11) ADA parking spaces in visitor parking lot have been de- striped. Where are the spaces going to be, and where are the ADA ramps to accommodate the spaces? 12) Doors along north wall should have windows in them rather than solid doors. Planning Department Review Site Plan Review Item #1 — A landscape plan is needed for all the areas under ownership. Please submit a landscape plan that includes an irrigation plan. The previously submitted and the modified attached show the landscape for the portion of land that is being developed under the project. This property is being irrigated with surface water from the canal company as directed by City engineering. So no connection to the city potable water system is needed for the irrigation. Item #2 — Please provide trash enclosure details. Trash receptacles must be fully screened from the right -of -way using materials similar to those on the building facades. Screening materials for the dumpsters must be similar to materials used in the building fagade itself, or landscaping (trees, shrubs, etc) must be provided to block the proposed chain link screening. Please see revised attached landscaping plan that provides plant screening in addition to the chain link fence with vision slats. Item #3 — Please provide a lighting plan with photometric layout information. Lighting standards limit the height of parking area lights to 25 feet. Proposed lights are 32 feet high. Also, any building mounted lights must be full cut -off. See attached photometric layout reflecting 25 foot tall fixtures. All specified fixtures are cut -off dark sky compliant. Please move the three light poles along the east property line, since their proposed location will be in the future right -of way for the future road. Due to safety and security concerns, the Owner has elected to keep the fixtures at the current locations. The current locations provide important lighting at the access drives that allows patrons to see as they entire onto the property and parking lot. When and if this becomes a City road, the fixtures in question will be relocated. If the City is willing to accept the potential liability in writing then the Owner will agree to the relocation. The lights along the north property line must be treated to prevent direct illumination of the right -of -way. The ordinance reads: "All light fixtures, including security lighting, shall be aimed and shielded so that the direct illumination shall be confined to the property boundaries of the light source. Care shall be taken to assure that the direct illumination does not fall onto or across any public or private street or road. Freestanding luminaries that are closer to the property boundary than 3 times the height of the lamp above grade shall use an asymmetrical light distribution or shall be fitted with a cutoff shield (also know as house -side shields) such that the illuminance at the property boundary is less than 1/20 of the maximum from said luminaire." Please revise. The fixtures in question will be moved (as indicated on attached photometric drawing), south 15 feet further away from the property line. In reviewing the City ordinance above, it is assumable by the action of the City prohibiting any illumination to fall onto the public right -of -way, that the City is thereby assuming any safety related liability. Commercial New Construction Over 2 million Item #1 — Since the North fagade of the gymnasium area faces the street, elements to visually break up the fagade are required. The Design Review Committee suggests incorporating the same columns and glass windows from the East and West gymnasium fagade onto the North Gymnasium fagade. Please see attached drawing showing the addition of piers and entry canopy. Please note that behind this wall is a mechanical room and walk -in cooler /freeze, both of which required use of the exterior wall space thereby prohibiting the addition of windows. Keep in mind that the design ordinance only required a 6-foot planter between the building and walk. As requested we have provided a 10 foot planter with evergreen trees to help visually break up the elevation. Item #2 — All outside equipment for cooling, etc. must be fully screened by incorporating it into the design of the building. We are concerned with the equipment on the roof at the North end of the building. The cooling tower must be screened as required by ordinance. Please show this on revised elevation drawings. BACKGROUND The applicant has requested a conditional use permit to allow construction and operation of a high school and elementary school on the same larger parcel, but in different locations within the parcel. After reviewing the proposal and working with the applicant, it was determined that the hearing of the high school portion of the property should wait until a Traffic Impact Study (TIS) is completed. This analysis is underway but was not ready at the time of this first hearing. Therefore, this staff report will only address the proposed elementary school and how it relates to the criteria established for conditional use permits. The Commission should only consider the elementary portion of this proposal at this time and make a recommendation to the City Council on only the elementary school. Case No. 07 00307 Page 1 • • The Commission should, in consulting with the applicant, set a date certain at which the public hearing for the proposed high school will be heard. Staff recommends 60 days or less. Land uses that require conditional use permits are allowed within a zone if, through reasonable conditions of approval, the use and/or facility will not adversely impact the neighborhood and community of which it belongs. Therefore, the City, upon receipt of a CUP request, should review the proposal and either approve, deny, or approve with conditions. II. SITE DESCRIPTION The subject property is a 6,882,695 square foot (158 -acre) parcel located on the west side of Rexburg generally the northwest corner of University Boulevard and S 12 West. The proposed area designated for use as the elementary school includes approximately 12 -acres of land directly adjacent to W 7 th South (future collector street). The surrounding neighborhood is predominantly agricultural use with some single family homes in the area, particularly to the east (Willowbrook Subdivision). III. ANALYSIS The following are the criteria for granting a conditional use permit. Some of the criteria is followed by staff's analysis. A conditional use will: a. Constitute a conditional use as established in Table], Zoning Districts, and Table 2, Land Use Schedule. The proposed use is listed as a conditionally permitted use under Section 3.28.020(F) of the Development Code; therefore, this criterion is met. b. Be in accordance with a specific or general objective of the City's Comprehensive Plan and the regulations of this Ordinance. The City's adopted comprehensive plan, Rexburg: 2010 lists as an Action Step under the Transportation and Circulation section, "Make it easier and safer for people to travel by foot or by bicycle by developing bike paths, lanes, and routes which connect residential neighborhoods, schools, and employment. Generally, elementary schools should be located on local roads that are intended for residential traffic. This reduces the amount of potential vehicle /pedestrian conflicts that might occur at a higher frequency on a collector and arterial street. Given that this location is currently intended to serve a more rural student body, the Commission may determine that this criterion is met when considering all factors. However, it is likely that this southwest area of the City is likely to grow in both residential and commercial land uses. As a result, steps should be taken now to ensure that the development will transition with growth. The applicant has begun to address this with observing required rights -of- way and extending sidewalks in front of the school on 7 th South. Staff would recommend the sidewalk construction and right -of -way dedication be extended to the east to 12 West. At 12 West, the intersection should be improved to allow for adequate turn lanes and sidewalks with handicapped accessible ramps. As there is likely to be residential growth occurring to the north, a condition of approval may be that the applicant must agree to financiallz participate in future pedestrian safety improvements (e.g. crosswalks, signals, etc.) across 7 South. The timing and scope of those improvements will be dictated by the City Engineer. Those improvements would include maintenance responsibilities as well. In addition any recommendations put forward by the traffic impact study should be adhered to. Case No. 07 00307 Page 2 • c. Be designed and constructed in a manner to be harmonious with the existing character of the neighborhood and the zone in which the property is located. The surrounding land uses include single - family homes and mostly agricultural land. In many ways, the new building and site might establish the ambiance of future development in the area. The City has architectural design standards for buildings. One way to ensure that the development incorporates what the City has established as good architectural and site design, a condition of approval could be that the proposed building and site adhere to the City's design standards or as negotiated with the established Design Review Committee (DRC). Elements from both the commercial and residential design standards should be considered. Being subject to the City's architectural design standards will ensure that the site will be built more to a pedestrian/neighborhood scale by requiring large expanses of walls and rooflines to be architecturally "broken up," for example. As conditioned, this criterion is met d. Not create a nuisance or safety hazard for neighboring properties in terms of excessive noise or vibration, improperly directed glare or heat, electrical interference, odors, dust or air pollutants, solid waste generation and storage, hazardous materials or waste, excessive traffic generation, or interference with pedestrian traffic. Regarding glare and heat, the City's established lighting standards should be adhered to. Regarding electrical interference, no impacts are foreseeable. Regarding dust and air pollutants, the City has nuisance laws that should be adhered to. In addition, during development of the site (site disturbance), blowing dust should be minimized through dust control measures, such as establishing a vegetative cover after site disturbance, mulching, irrigation, or organic spray -on adhesives, where appropriate. Should dust generated from the site become a problem for the adjacent properties, a dust control plan should be submitted immediately to the City Engineer for review and approval. After the site has been developed, all disturbed areas should be re- vegetated within 21 -days, or as weather permits. Regarding the potential impacts of noise and vibration, the commission should explore this issue and determine if reasonable conditions of approval need to be applied. Regarding solid waste generation and storage, trash receptacles should be fully screened from the public right -of -way and should not be visible from adjacent residential property. There should be no outside storage of material or equipment unless fully screened form public right -of -way. This screening, if in it self is deemed objectionable by affected property owners, should be approved by the Planning Commission or designee. Staff has included proposed conditions of approval that address trash storage and general storage occurring on the outside of the building. Regarding excessive traffic generation, or interference with pedestrian traffic, the applicant is in the process of completing a TIS to determine levels of service for adjacent roads and affected intersections. In anticipation of traffic generation and potential impacts, the applicant is proposing improvements at the site including acceleration and deceleration lanes. The anticipated TIS will provide improvement recommendations; a proposed condition of approval is that these recommendations be adhered to. In order to avoid pedestrians heading to the east, the previously mentioned improvements to sidewalks to the east should be adhered to. Canal safety for pedestrians along designated routes should be explored with the applicant. The Commission should determine if through reasonable conditions of approval this criterion can be met. Be adequately served by essential public facilities and services such as access streets, police and fire protection, drainage structures, refuse disposal, water and sewer service, and schools. If existing facilities are not adequate, the developer shall show that such facilities shall be upgraded sufficiently to serve the proposed use. The subject property is located within the City limits and is therefore served by essential services other than water and sewer service. Water and sewer infrastructure will be extended from 12 West at the applicant's expense; the City will maintain the lines once installed and inspected. Based on existing and proposed public services being provided, this criterion is met. In addition, site development will undergo review by the public works department to ensure all required city services and utilities are supplied. f. Not generate traffic in excess of the capacity of public streets or access points serving the proposed use and will assure adequate visibility at traffic access points. Staff is not able to determine this at this time. A traffic impact study is being completed which describe current and projected road conditions and levels of service. The study will include recommendations for road improvements that will enable the school to occupy its proposed location. The school is proposing acceleration and deceleration lanes immediately in front of the school site. These lanes will prevent school traffic from interfering with through traffic on 7th South. The site also includes a internal driveway that is configured and aligned with the future 13 West road. It is recommended that the road right -of -way be dedicated at this time, or a time certain, with an agreement that the internal driveway be maintained by the school district until the road develops and functions as a pubic road (see conditions of approval). Staff recommends requiring the proposal to be subject to all recommendations made by the traffic impact study. This has been made a proposed condition of approval. The commission should explore this criterion to determine if it is met, or can be through reasonable conditions of approval. g. Be effectively buffered to screen adjoining properties from adverse impacts of noise, building size and resulting shadow, traffic, and parking. Regarding noise, the hours of operation will be typical to most elementary schools, in that peak occupancy will occur during fall, winter, and spring days. There will be some evening gatheraing as well as potentially meetings for community use. Most noise will be generated during the day with children playing, vehicles coming and going, and mechanical equipment. Large heating and cooling equipment will likely be used which will generate noise. The Commission may want to condition the use such that equipment that will generate noise be located a maximum feasible distance from existing and future residential uses surrounding the property. The applicant should be encouraged to incorporate large heating/cooling /ventilation equipment that uses technology that reduces noise impacts. Noise generated by large groups of children will be mostly generated in the rear of the building. Landscape buffers between school and future areas of residential uses should be incorporated now to allow for proper maturation (see proposed conditions of approval). A landscape plan will need to be submitted as part of site plan review and building permit review (see proposed condition of approval). The proposed buildings should be consistent with other new buildings in the City. Specifically, the City has incorporated architectural design standards that are intended to increase the aesthetics of the City as well as create more human scale buildings and environements. The Design Review Committee should explore the design and negotiate with the designer a building that most closely meets the intent of the design standards (see conditions of approval). The proposed structure and site being subject to the City's architectural design standards should negate and potential building size impacts. The City requires minimum setbacks and screening for parking areas. These requirements will be reviewed during the site plan/landscape plan review phase when the applicant submits a building permit application. The Commission should point out any significant areas of concern for staff to follow up with during the site plan review phase. The Commission should determine if the proposal as proposed, or with conditions satisfies this criterion. h. Be compatible with the slope of the site and the capacity of the soils and will not be in an area of natural hazards unless suitably designed to protect lives and property. Not applicable i. Not result in the destruction, loss or damage of a historic feature of significance to the community of Rexburg. Not applicable IV. STAFF RECOMMENDATION Staff recommends that the Commission take public testimony and determine if the proposed conditional use permit can be approved, denied, or approved with conditions. Staff has proposed some conditions of approval, should the Commission choose to approve with conditions. Proposed Conditions of Approval 1. Trash receptacles shall be fully screened from the public right -of -way and should not be visible from adjacent residential property. 2. There should be no outside storage of material or equipment unless fully screened form public right - of -way. This screening, if in it self is deemed objectionable by affected property owners, should be reviewed and approved by the Planning Commission or designee. 3. A site plan reflecting all conditions of approval and incorporating all City standards, e.g. landscaping, parking, etc. shall be submitted and approved by the City prior to the issuance of a building permit. 4. Commercial lighting standards per the City's development code shall be adhered to. 5. Large equipment that is to be located on the subject property and is to used for heating/cooling /ventilation of the proposed building(s), or similar uses, shall be located the maximum feasible distance from any adjacent residential dwelling unit, and shall incorporate any current technology that reduces noise generation. 6. As there will be residential growth occurring to the north, which due to the location of this school will require student to cross 7 South a collector street, the applicant shall agree to financially participate in future pedestrian safety improvements (e.g. crosswalks, signals, etc.) across 7 South. The timing and scope of those improvements will be dictated by the City Engineer. Those improvements would include maintenance financial responsibilities as well. 7. Design of safety fencing shall be reviewed and approved by the City Engineer. 9. The applicant shall agree to dedicate the right -of -way of the future 13 West. Currently this is proposed to be the internal driveway serving guest parking. 10. The proposal shall be subject to all recommendations made by the traffic impact study. Installation of recommendations must occur before occupancy of building occurs. 11. To buffer noise generated by large groups of children, landscape buffers between the school and future areas of residential uses (those areas currently designated as residential on the Comprehensive Plan map should be incorporated now to allow for proper maturation 12. On August 15, 2007 John Watson of JRW & Associates reviewed the proposal on the overhead screen. This Conditional Use Permit (CUP) is for the Burton Elementary School on 12t West and 7 th South. They are doing a traffic study on the site before coming forward with the CUP request for the new high school. Keller and Associates along with Winston Dyer and John Millar will work on traffic plans. Currently, the property the school is on is zoned as TAG 1 which requires a CUP. The school district recommends having schools on at least 15 acres. Burton Elementary is on 13 acres. Council Member Young asked if it is required to have schools on at least 15 acres. John Watson explained this is just recommended, the school district is okay with the 13 acres Burton Elementary is currently on. Council Member Erickson asked if 12 West and 7 th South the school could culvert all the way to the end of the property for pedestrian safety. Children will be walking from the east and north to the school. A fence around the ditch will be a trash catcher. JRW concurred with the need to culvert all the ditches around the school area. The Planning and Zoning conditions are agreeable to the owner. Council Member Erickson moved to approve the Conditional Use Permit for Burton Elementary with the condition outlined by city staff and with the condition a culver ditch is put in all the way down from 12t West to the Canal.
