On July 5, 2007, Alicia Thornburg presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Conditional Use Permit for dormitory housing located at 366 West 3` South and 276 Steiner Avenue. 2. On July 9, 2007, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for July 17, 2007, and July 28, 2007. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 3. On August 2, 2007, Alicia Thornburg presented to the Planning & Zoning Commission for the City of Rexburg the Request for a Conditional Use Permit for dormitory housing located at 366 West 3` South and 276 Steiner Avenue. Mary Ann Mounts motioned to table the Conditional Use Permit for dormitory housing at 366 West 3 South & 276 Steiner Avenue until the applicant can present a revised site plan that incorporates the identified code requirements. We will pick the issue up again at the next meeting (August 16). Ted Hill seconded the motion. On August 16, 2007, Alicia Thornburg presented to the Planning & Zoning Commission for the City of Rexburg the revisions to the request for a Conditional Use Permit for dormitory housing located at 366 West 3rd South and 276 Steiner Avenue. David Stein motioned to recommend to City Council to approve the conditional use permit at 366 West Y South and 276 Steiner for dormitory housing, subject to standard conditions in the zoning ordinance, as well as the conditions as recommended by staff. In addition, that the two recreation patios be adjusted so that no parking could feasibly take place there, and that a tree be moved so the parking is screened on the east side of the parking lot. Thaine Robinson seconded the motion. Charles Andersen, Dan Hanna, Chairman Dyer and Josh Garner abstained for having not bee participants in the hearing process. None opposed. Motion carried. On September 5, 2007 Council Member Erickson moved to approve the Conditional Use Permit for 366 West 3rd South and 276 Steiner Avenue contingent upon the Planning and Zoning Conditions being met. Council Member Stevens seconded the motion; Discussion: Council Member Benfield asked who voted for the CUP at the Planning and Zoning meeting. The minutes were reviewed to see who voted for the CUP. Council Member Mann discussed the need to protect single family housing. City Attorney Zollinger explained the zoning allows this type of housing. All voted aye, none opposed. The motion carried. 6) Conditional - ' "�' o al Use Permit Proposed Conditions of Approval Revisions (.I 1. Sanitation Waste: a. Trash receptacles are screened with vinyl fencing, a 6x8 ft section 'j installed at 276 Steiner, and 4x1Oft section installed at 366 W 3 S to match the existing fencing. The garbage receptacles are not visible from adjacent residential properties. If the need for additional receptacles arises to avoid overflow we will provide additional receptacles per unit. 2. Landscaping Plan: a. 276 Steiner Avenue- The front yard facing Steiner is fully landscaped with an automated sprinkler system, sod, shrubs (a variety of spirea, burning bushes, daisies, clematis, and trumpeter vine), Maple trees, and flowerbeds. The side yard facing 3` South is also fully landscaped with an automated sprinkler system, sod, pavers, maple trees, birch trees, arborvitae hedge, and flowerbeds. White vinyl fencing has been added for screening of parking from adjacent properties. Total green space: 61.7% b. 366 W. 3` S.- The front yard and side yard is fully landscaped with an automated sprinkler system, sod, Blossoming Cherry Tree, arborvitae hedge, Lilac trees and flower beds. The backyard is completely landscaped with automated sprinklers, sod, lilac trees, apple trees, maple tree, large patio, and flowerbeds. The backyard is fully fenced and is accessible from the left side of the home with a 4ft vinyl gate. Total green space: 73% 3. Screening: a. Vinyl fencing has been installed to the north of the parking to screen it from the property at 264 Steiner Avenue. b. An arborvitae hedge has been planted on both sides of the parking driveway to screen it from traffic approaching the property from the East and West. c. Lilac trees (12 -15ft) line the west fence line of #366 screening it from the neighbors to the west. There is a 6 ft fence to the north of the property with Apple trees, lilac bush, and a maple tree to add additional screening to the North. 4. Lighting: a. The North end of the parking will have a 6 ft x 22ft maneuvering area for the last parking stall. We have also increased the width of the 2 -way traffic from 22 ft to 24 ft. 6. Raised concrete curbing: a. We are proposing to have concrete curbing installed as well as raised flowerbeds in some areas to well define parking spaces, protect green space, and prevent impromptu parking. 7. Site Drainage Plan: a. All existing concrete and newly poured concrete was sloped to the east and west green space. We have also submitted our site plan to the city engineer for approval and are awaiting his feedback. 8. Signage: a. Two of these homes applied for the same permit last year, and many of my reasons for opposition are the same. These reasons include Dear Planning and Zoning Commission 1. The street is narrow, and already there are problems with parking. Because this is a narrow, dead end street, with no circle or cul -de -sac, there is not a lot of room for cars to drive or turn around. Even the garbage truck has to turn around before it comes down the street. I am concerned that the increase in traffic would make traffic and parking a serious problem. 2. If you drive down the street you will be able to tell the owner occupied homes immediately by their well kept lawns and yards. On most of the rental lots, a few trees have died and been chopped down, and many of the lawns are brown and dying. In the last few months the owners of the homes at 366 W 3 S and 276 Steiner Ave have done some work to improve the homes, but I am concerned that if the Condition Use Permit is granted, then the homes will be neglected and fall into disrepair again. 3. I have heard that the owners of these units are asking for this Condition Use Permit to make what they have been doing for the last few years "legal ". If this is true, than I am very concerned about their future compliance. How can we expect them to comply with all the rules /regulations if they don't have a history of compliance in the past? 4. This is a "family" street. Granted there are some houses being used as apartments, but there are single family homes also. One of the reasons I purchased my home in this area is because of the quiet neighborhood, and I would be disappointed to see that disappear. In discussing with the owners, the status of BYU -I housing approval for Crccksidc Cottage I &II, I have been impressed with the organization and promptness of responses. The Haney's /Thornburg's have gone out of their way to help me receive the information needed. Lastly I want to talk about the location. In looking at these houses, I can sce that the property is well kept and the houses arc in great condition. There are many housing complexes out there that are not in as good of condition as these. Creekside Cottage I&II are in a very great location. They are close enough to BYU -I to give students needed access, while still giving them the quiet atmosphere needed fox studying.
