NOTICE OF PUBLIC HEARING
TO AMEND THE PLANNING AND ZONING ORDINANCE No. 926
TITLED: DEVELOPMENT CODE ORDINANCE 926
FOR THE CITY OF REXBURG
NOTICE IS HEREBY GIVEN that a Public Hearing will be held April 05, 2007,
at 7:30 p.m. before the Rexburg Planning and Zoning Commission of the City of Rexburg,
Madison County, Idaho, to amend the current DEVELOPMENT CODE ORDINANCE 926.
It is proposed to review the current DEVELOPMENT CODE ORDINANCE 926 and
make amendments to the Plan concerning the Transitional Agriculture One (TAGI) and
Transitional Agriculture Two (TAG2) zoning provisions.
Additions or modifications to the New DEVELOPMENT CODE ORDINANCE 926
include:
1. Modifications to the permitted, accessory, and conditional use tables.
2. Modifications to minimum lot areas required of newly created parcels.
3. Modifications to the lot frontage standards.
4. Modifications to the front, side, and rear yard setbacks.
5. Modification of maximum building heights.
6. Standards set for maximum lot coverages.
At such Public Hearing the Rexburg Planning and Zoning Commission will hear all
persons and all objections and recommendations relative to the DEVELOPMENT CODE
ORDINANCE 926 that will be proposed. This notice is given to the provisions of Section 67-
6508, Idaho Code and all amended thereof.
The City Council encourages all City residents to participate in the process to amend the
the DEVELOPMENT CODE ORDINANCE 926. Citizen's comments may be submitted to the
City Clerk in writing or by email during the fact finding period. All interested persons are
invited to offer their views on the DEVELOPMENT CODE ORDINANCE 926 for the City of
Rexburg in writing to the Community Development Office at 19 East Main Street in Rexburg.
The City Clerk located at 12 North Center Street, will receive written input for this
Public Hearing prior to 4:00 p.m. on April 04, 2007.

Transitional Agriculture 1 and Transitional Agriculture 2
Zoning Ordinance Amendment
1. On March 14, 2007, the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper for March 17, 2007, and March 31, 2007.
2. On April 5, 2007, Gary Leikness presented to the Planning & Zoning Commission for the
City of Rexburg the Request for a Zoning Ordinance Amendment for Transitional
Agriculture 1 and Transitional Agriculture 2. Thaine Robinson motioned to recommend
to City Council to revise the Transitional Agriculture 1 and Transitional Agriculture 2 zones
in the Development Code as proposed. David Stein seconded the motion. None opposed.
Motion carried.
3. On May 02, 2007 Council Member Young asked who requested this amendment. City
Attorney Stephen Zollinger said there are some loopholes in this ordinance that need to be
modified before someone takes advantage of it. No one person or organization has made
this request.
Council Member Erickson said this is a situation where Planning and Zoning has
remedied these loopholes and they should be commended for their work.
City Attorney Stephen Zollinger asked the City Council to waive the rules on Bill 983
amending Ordinance 926 and approve as third read.
Council Member Stevens motioned to suspend rules considering this third read on Bill
983. Council Member Erickson seconded the motion. Roll call vote:

Council Member Erickson motioned to adopt Bill 983 as 3` read. Council Member
