What we propose is that the cage be placed facing 2nd East 44 feet south from the door. There are two reasons for this placement focusing on safety and fire code. 1: The cage has to be within 50 ft of a fire extinguisher; which is located inside the front door. 2: There has to be a 6 in side- walk protecting the cage. Placing the cage in this location will place it partly in front of the dark fake front glass window (which has a brick wall behind the glass). We propose the cage be painted two tone; the top black to blend in with the dark wall. The lower half will be painted to match the sand stone brick wall. The only signange on the cage would be pricing and any required by law. We have looked at placing the cage down in front of the brick wall. To assure the safety of customers, employees and the community we propose the above placement. On March 12, 2007, Jason Kimber of Walgreens presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Conditional Use Permit for the sale of bottled propane at the Walgreens store located at 164 East Main Street. 2. On March 29, 2007, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for April 14, 2007, and April 28, 2007. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 3. On May 3, 2007, Nola Jensen of Walgreens presented to the Planning & Zoning Commission for the City of Rexburg the Request for a Conditional Use Permit for the sale of bottled propane at the Walgreens store located at 164 East Main Street. Thaine Robinson motioned to recommend to City Council that we allow Walgreens to sell propane on the 2 nd East side of the building, as close to the south end as possible. On May 16, 2007 Planning and Zoning Administrator Leikness reviewed the discussion at the public hearing before Planning and Zoning. The City Council was referred to the "Finding of Facts" and minutes from the Planning and Zoning public hearing. The Planning Commission said this location is the entry into the downtown area. The applicant and their supplier is willing to work with the city to maintain the look of the downtown entry area. The Planning Commission recommended a 2 nd East location with proper screening. Council Member Stevens moved to approve the 2nd East location with painting consistent with the color of the building. Council Member Erickson seconded the motion; Discussion: Council Member Mann asked if the 2 nd location is the location recommended by Planning and Zoning. Yes.
