understanding that city utilities have been extended out to 12`'' west as far as Madison County Implement.
Our properties are located just on the other side of the street.

be extended across the street to include several property owners on the west side or 12''' West.

after an application has been accepted as complete.

On January 18, 2007, Kerry Schneider presented to the Rexburg Planning & Zoning
Coordinator a Request and Application for an Annexation and Rezone located at 1076 South
12 West and surrounding properties to Low Density Residential 2. (See Proposed Annexation
map, 07- 00401)
2. On February 12, 2007, the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper for February 14, 2007 and February 24, 2007. A notice was posted on the
property and sent to all property owners within 300 feet of the above mentioned properties.
3. On March 1, 2007, Kerry Schneider presented to the Planning & Zoning Commission for the
City of Rexburg his request for Annexation and Rezone located at 1076 South 12` West and
surrounding properties to Low Density Residential 2.
Mary Ann Mounts motioned to recommend to City Council to annex only the area of the
proposal that is inside the impact area, to allow the new planner to determine the best land
use in the area. She motioned we zone the portion that is designated on the Comprehensive
Plan Map as "Low- Moderate Residential Density" as LDR2, and leave the portion that is
designated "Commercial" on the Comprehensive Plan Map as Transitional Agriculture 1
(TAG1). Thaine Robinson seconded the motion. None opposed. Motion carried.
4. On March 21, 2007, Council Member Erickson moved to annex the parcels as proposed by
the applicant contrary to the total recommendations from the Planning and Zoning Commission
in a public hearing on March 1, 2007. The annexation is conditioned upon the city of Rexburg
receiving the dedicated water rights associated with the parcels as the property is developed and
receiving the necessary right -of -way dedicated to the City of Rexburg on 12 West and 2000
South. Council Member Young seconded the motion with the understanding the City of
Rexburg and Madison County will immediately and vigorously work together to expand the
Impact Area for the City of Rexburg. Discussion: Planning and Zoning Administrator Leikness
explained this is an annexation and a rezone request. The requested LDR2 Zone for properties
against 12 West does not comply with the commercial land use designation on Rexburg's
Comprehensive Plan Map. Council Member Erickson amended his motion to include the
zoning to be LDR2 for all parcels except property adjacent to 12 West which will remain
Transitional Agriculture 1 (TAG1) as shown on the Preferred Land Use Map.

Annexation & Rezone
On January 18, 2007, Kerry Schneider presented to the Rexburg Planning & Zoning
Coordinator a Request and Application for an Annexation and Rezone located at 1076 South
12` West and surrounding properties to Low Density Residential 2. (See Proposed Annexation
map, 07- 00401)
2. On February 12, 2007, the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper for February 14, 2007 and February 24, 2007. A notice was posted on the
property and sent to all property owners within 300 feet of the above mentioned properties.
3. On March 1, 2007, Kerry Schneider presented to the Planning & Zoning Commission for the
City of Rexburg his request for Annexation and Rezone located at 1076 South 12 West and
surrounding properties to Low Density Residential 2.
Mary Ann Mounts motioned to recommend to City Council to annex only the area of the
proposal that is inside the impact area, to allow the new planner to determine the best land
use in the area. She motioned we zone the portion that is designated on the Comprehensive
Plan Map as "Low- Moderate Residential Density" as LDR2, and leave the portion that is
designated "Commercial' on the Comprehensive Plan Map as Transitional Agriculture 1
(TAG1). Thaine Robinson seconded the motion. None opposed. Motion carried.

FOR THE CITY OF REXBURG
NOTICE IS HEREBY GIVEN that a Public Hearing will be held February 07, 2007,
at 7:30 p.m. in the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho,
before City Council of the City of Rexburg, Madison County, Idaho, to consider amending the
current Comprehensive Plan Map as shown on the attached map. The proposed Map changes are
located inside the City of Rexburg and in the Impact Area for the City of Rexburg. The areas for

City of Rexburg Preferred Land Use Map be changed to "Transitional Agriculture ", said property more
particularly described as follows:
Southeast Quarter of Section 13, Township 6 North, Range 39 East of the Boise, Meridian, Madison
County, Idaho. Less the following:
Commencing at a point that is North 89 35' East, 705.0 feet from the SW corner of the SE1 /4 of
Section 13, Township 6 North, Range 39 East of the Boise Meridian, Madison County, Idaho, and
running thence North 6 07' East, 1324.3 feet; thence North 89° 35' East, 503.27 feet; thence South

It is proposed to review the current Comprehensive Plan Map and consider making
amendments to the Map as needed to reflect the community's vision for the growth of the
community in the next 10 plus years. As the community is experiencing substantial growth at this
time, the community's vision for the growth of the City needs to be reviewed.
At such Public Hearing the Rexburg City Council will hear all persons and all objections and
recommendations relative to the Comprehensive Plan Map revisions that will be proposed.

Comprehensive Plan Map. Citizen's comments may be submitted in writing or by email during the
fact finding period to the City Clerk at City Hall located at 12 North Center Street, Rexburg, Idaho,
prior to 4:00 p.m. on February 06, 2007. All interested persons are invited to offer their views and
vision for the City of Rexburg for the next 10 plus years of development.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before City Council of
the City of Rexburg, Idaho, Wednesday, March 211 2007, at 7:30 p.m., in the City Council
Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding annexation of
approximately 228 acres of land west of 12th West and southwest the John Deere complex.
Water and sewer services will need to be extended to the annexation parcels. Future road
development will be as per the City transportation plan as coordinated with Madison County.
The property is located west of 12th West and southwest the John Deere complex on 12th
West in the Rexburg City Area of Impact, Madison County, Idaho and Madison County,
Idaho. The properties are described as follows on the Annexation Map dated February 14,
2007:
Tract 1:
The Southeast quarter of section 36, Township 6 North, Range 39 East of the Boise
Meridian.
Tract 2:
The Northeast quarter of the Northeast quarter of section 2, Township 5 North, Range 39

annexing to the property within "Rexburg City's Area of Impact ".
