A 0 0 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before City Council of the City of Rexburg, Idaho, Wednesday, February 21, 2007, at 7:30 p.m., in the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding a zone change from Medium Density Residential One (MDR1) to Community Business Center (CBC). The Planning and Zoning Commission recommended changing the zone to Professional Office (PO). The city code governing this request is ORDINANCE No. 926 "DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO" (ADOPTED FEBRUARY 16th, 2005) and Amended June 21, 2005 The said parcel is located at approximately 261 North 3rd East in Rexburg, Madison County, Idaho, and more particularly described as follows: Tract I: Commencing at a point 65 feet north of the Southeast Corner of Lot 1, Block 17, of the Original Rexburg Townsite, Madison County, Idaho, as per the recorded plat thereof, and running thence west 190 feet; thence north 50 feet; thence east 190 feet; thence south 50 feet to the point of beginning. On November 27, 2006, Jeff Hopkin presented to the City of Rexburg Planning & Zoning Coordinator a request and application for a zone change at approximately 261 North 3` East from Medium Density Residential 1 (MDR1) to Community Business Center (CBC). 2. On November 28, 2006, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for December 30, 2006 and January 13, 2007. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 3. On January 18, 2007, Jeff Hopkin presented to the Planning & Zoning Commission for the City of Rexburg the Request for a Rezone at approximately 261 North 3` East from Medium Density Residential 1 (MDR1) to Community Business Center (CBC). David Stein asked why he did not propose Professional Office zone. Jeff Hopkin said he does not have strong feelings. They thought it would be good to match the zoning of Dr. Lewis' office. The City's Comprehensive Plan designates this property as Commercial. Charles Andersen asked if staff would recommend the Professional Office zone over the Community Business Center zone. GaKy Leikness said staff would be in support of the Professional Office zone. Thaine Robinson asked if we can change the property to Professional Office. Chairman Dyer said we can, since we are only making a recommendation to City Council, and the new zone is less intensive or impactive than the originally proposed zone. Charles Andersen motioned to recommend to City Council to change the zone on the property located at approximately 261 North 3` East from Medium Density Residential 1 (MDR1) to Professional Office Zone (PO). Dan Hanna seconded the motion. None opposed. Motion carried. 4. On February 21, 2007 a public hearing was held to re -zone property near 261 North 3` East from MDR2 to Professional Office (PO). Gary Leikness reviewed the proposal on the overhead screen. The intent is to have a medical office. The Comprehensive Plan calls for a commercial office zone. Neighboring property owners as well as the applicant and planning and zoning recommended it be a Professional Office Zone. Mayor Larsen opened the public hearing. Council Member Benfield said Professional Office is an appropriate zone. There is already a dentist next to them. The land owner to the south is very happy with this proposal. • • Council Member Benfield moved to re -zone the property near 261 North 3" East from MDR2 to Professional Office (PO); Council Member Erickson seconded the motion; Discussion: Council Member Mann asked if the property is protected from going commercial. Planning and Zoning Administrator Gary Leikness said this is not a concern. Mayor Larsen asked for a vote: all voted aye, none opposed. My sister, Ilene Olsen, is the owner of the Northtown Village Apartments located next to (south) and abutting the Hopkins Property_ As I have assisted her in the management of this property for over ten years since her husband's stroke and subsequent death, she has asked that I review this action and make comments to the City in her behalf Also, having been involved in the real estate brokerage, development and management industry for over thirty years my remarks come from many years of experience in addressing the type of matter that is before the Planning Commission on the proposed Hopkins Property rezone. .A, matter of great concern is that the proposed CSC zone designation is very broad in the allowable commercial uses that can be placed on the property. There has been indication that the intended use on the Hopkins Property would be for a professional office building, however if the property were granted the rezone as requested, the property owner would be under no obligation to ultimately use the property for professional offices. This is what concerns us. The Northtown Village Apartments consist of 16 apartment units that are rented to primarily families, many of which have young children. The neighborhood along 3 East is either single family homes or apartments. It is generally quiet at night with very little traffic and is ideal for those wishing to enjoy a comfortable home environment. 01/18/2007 02:45 8012988213 CRAIG GASSER PAGE 03/03 Rexburg City Planning Commission January 18, 2007 Page 2 By introducing a commercial use adjacent to the Northtown Village Apartments, possibly, similar to those type of businesses located on 2 nd East would be a travesty and imposition, to say the least, on those who call Northtown Village Apartments their home. Issues range from noise, traffic, lights, congestion, vandalism and more as possible detriments that follow commercial type business establishments. Our concern is not as much the rezone to allow for a professional office use as much as it is for the many different commercial uses that are permitted under the CBC zone_ Once the property is rezoned CBC, the property owner is under no obligation to build professional offices, and we have strong objections to allowing many, if not most of the permitted uses under the CPC zone designation on the Hopkins Property. So as not to discourage the sale of the land or its development, we would favor and support the proposed CBC rezone if there was also placed on it a Professional Office (PO) zone overlay thereby allowing the proposed development to go forward but also restricting the uses on the property to that which is allowed under the PO zone. The CBC zone with a PO overlay is still consistent with the intentions of the comprehensive plan, and is more acceptable to us as an adjacent property owner.
