On December 21, 2006, Timberhawk presented to the Rexburg Planning & Zoning Coordinator a Request and Application for a Final Plat for The Meadows, Phase 2. 2. On January 18, 2007, Trever Einerson presented to the Rexburg Planning & Zoning Commission the Request for approval of the Final Plat for The Meadows, Phase 2. Thaine Robinson motioned to recommend to City Council to approve the Final Plat for The Meadows, Phase 2, with the conditions that prior to the City signing the plat, the name of Red Tape Street be changed, and the contract with the Steiner's be recorded and turned into the City. Dan Hanna seconded the motion. Thaine Robinson amended his motion to include the condition that the sidewalk on the South property line be moved onto the right of way. Dan Hanna seconded. Chairman Dyer abstained. None opposed. Motion carried. 3. On February 07, 2007 in City Council, Council Member Erickson moved to approve Final Plat for "The Meadows Phase Two" with those conditions recorded; Condition One: contract with the Steiner's to have an exit going north. Condition Two: Street name change from Red Tape Drive to Timberhawk Drive. Council Member Benfield seconded the motion; Discussion: Council Member Stevens would like the applicant or a representative present for the final plat reviews. Council Member Mann said this type housing is needed in the community. Mayor Larsen said they have made improvements to the properties. All voted aye, none opposed. The motion carried. ' ` --'.T~ & r`st.~iow 30X 732 To whom it may concern, This letter is in response to the request of Robert Lamoreaux for clarification regarding development requirements, and allowances of the City of Rexburg concerning the property located at 990 W. 7th S. Rexburg, Idaho 83440, also referred to as "The Meadows". The zoning on the subject property is currently MDRl which allows for the construction of up to 16 units per gross acre. The property is subject to the development requirements of City Ordinance #926, the City of Rexburg Development Code and the City of Rexburg Subdivision Ordinance. There are no other known zoning restrictions on the subject property. The property has two accesses onto 7th South Street and it is my understanding that these accesses meet the requirements of the fire district for proper access to the property. In order to accommodate the desires of the city planning office to create connectivity to the adjoining neighborhoods, the developer of 990 W. 7th S. is willing to connect to the Steiner property, which borders the north end of 990 W. 7th S., upon the development of the Steiner property, and is also willing to record the attached agreement. This action adequately addresses the desires of the City pertaining to connectivity and access. Development is required to be in compliance with whatever code and ordinances are in force at the time of actual development. The Preliminary Plat was presented in November 2006. After review and discussion from staff the following recommendations and or conditions were to be met. 1. Modify internal sidewalks to provide access from common element/open space of phase 1 to the new club house. Z. Submit landscape plan. (Must address all area of current proposed phase including but not limited to the detention pond and buffer on west side of property.) 3. Wheel stops should be provided for proposed parking spaces or sidewalk within. Should be increased to 6 feet to allow overhang of vehicles without preventing pedestrian activity on sidewalks. 4. Approval of this Preliminary Plat does not constitute an approval of building cross section and floor plans as shown on plat. 5. The final plat reflect the remaining elements that need to be added to the drawing. (Fire hydrants and garbage receptacles.) 6. The building footprints reflect the outline of the building as it conforms to our multifamily design standards. 7. Require a Master Plan of the entire development to be submitted with the final plat. 1. There is a walk way leading from phase one to phase two. In addition we have added a sidewalk on the interior of the park directly east of the Clubhouse. 2. The landscape plan has a small key on the plat. The Plat is showing 6 foot sidewalks to provide for a wheel stop. This is our choice apposed to regular wheel stops that often cause problems with skateboarders and are often popular for tripping pedestrians. 4. We understand this must be approved through the city. 5. These were on the Preliminary and you can see the trash receptacle is west of the buildings. The receptacle will have a vinyl surround matching the 6' fence to keep debris out of the development. 6. The Building Footprint on the new plat shows the outline of the foundation. From a first glance it would not appear to be in accordance with Rexburg Code 3.7.160 Design Standards. This can be found on pages 32-33 of The Rexburg Development Code. I have included all elevations for our proposed floor plan. After reviewing the elevations with Gary Leikness we believe all design standards have been met. 7. The Master Plan is still in engineering but the sketched drawing attached should give you a good idea of desires.
