NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that a Public Hearing will be held before the City Council of the
City of Rexburg, Idaho, Wednesday, June 21, 2006 at 8:15 p.m., in the City Council Chambers of the
City Building at 12 North Center, Rexburg, Idaho, pertaining to vacating a portion of the right of
way on Targhee Drive.
The said property is located at Grand Avenue and Targhee Drive ~I'rejo Professional Park) in
Rexburg, Madison County, Idaho and is described as follows:
Tract 1
Beginning at a point that is S89°48'44"W 595.84 feet along the east-west center section line and
S00°16'02"E 180.97 feet from the east quarter corner Section 25, Township 6 North, Range 39 East
of the Boise Meridian, Madison County, Idaho; running thence S89°32'54"W 104.39 feet to a point
on a curve having a radius of 40.00 feet and a chord that bears S49°45'17"E 52.16 feet; thence to the
right along said curve 56.82 feet thru a central angle of 81°22'46"; thence N89°32'54"E 124.73 feet;
thence NO°16'05"W 34 feet; thence S89°32'54"W 60 feet to the Point of Beginning.

Beginning at a point that is S89°48'44"W 595.84 feet along the east-west cent section line and
S00°16'02"E 180.97 feet from the east quarter corner of Section 25, Township 6 North, Range 39
East of the Boise Meridian, Madison County, Idaho; running thence S00°16'02"E 68.00 feet; thence
S89°32'54"W 44.38 feet to a point on a curve having a radius of 20.00 feet and a chord that bears
S44°33'58"W 28.28 feet; thence to the left along said curve 31.41 feet thru a central angle of
89°57'51"; thence N00°11'50"W 47.81 feet to a point on a curve having a radius of 40.00 feet and a
chord that bears N4°37'18"W 6.07 feet; thence to the left along said curve 6.075 feet thru a central
angle of 08°52'08"; thence N89°32'54"E 124.73 feet; thence SO°16'5"E 33.96 feet; thence
S89°32'54"W 60 feet to the Point of Beginning.
At such hearing the City Council will hear all persons and all objections and recommendations
relative to such proposed action. The City Clerk will also accept written comments at City Hall
prior to 4:00 p.m. on June 20th, 2006.
This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and all
amendments thereof.

Final Plat
1. On April 24, 2006, Terry Bagley presented to the Rexburg Planning & Zoning Coordinator a Request and
Application for a Final Plat for Trejo Professional Park, Division 2.
2. On May 18, 2006, Terry Bagley presented to the Rexburg Planning & Zoning Commission the Request for
approval of the Final Plat fox Trejo Professional Park, Division 2. Mary Ann Mounts motioned to approve
the final plat for Trejo Professional Park, Division 2 as drawn, with the condition that the canal issues and all
other staff review issues are dealt with. Mike Ricks seconded the motion. None opposed. Motion
carried.
3. On June 07, 2006, the City Council reviewed the Final Plat for Trejo Professional Park, Division 2. There
were discussions in other City Council meetings in reference to vacating a portion of Targhee Drive to allow
additional lots. City Attorney Zollinger indicated Division 2 contains a re-plat of a vacated portion of
Targhee Drive that was in Division 1. A public hearing is scheduled for June 21, 2006 to formally vacate a
portion of Targhee Drive for this plat. Council Member Erickson moved to approve the Final Plat for Trejo
Professional Park, Division 2 as presented; Council Member Stevens seconded the motion; all voted aye,
none opposed. The motion carried.
GENERAL QUITCLAIM DEED
The City of Rexburg, an Idaho municipal corporation acting by and through
Shawn Larsen as Mayor ("Grantor") hereby conveys and warrants to Bagley
Enterprises, a Idaho Company ("Grantee"), for the sum of Ten Dollars, that certain real
property in the County of Madison, State of Idaho, more particularly described as
follows:
Tract 1
Beginning at a point that is S89°48'44"W 595.84 feet along the east-west center section
line and S00°16'02"E 180.97 feet from the east quarter corner of Section 25, Township 6
North, Range 39 East of the Boise Meridian, Madison County, Idaho; running thence
