While we have in good faith attempted to meet all the requirements necessary to be granted Permanent Occupancy, some external issues have arisen causing us to ask for an extension of our Temporary Occupancy with the city of Rexburg. In our bank covenants we are under mandatory restrictions that limit the amount of money we can spend on capital expenditures each year. Due to unforeseen circumstances we have reached our allowed limit for 2007, and we are prohibited from spending more funds on capital expenditures, in this case landscaping. Because we have reached our allocated limit on amounts we can spend on capital expenditures we have no other option but to postpone the landscaping on the exterior of the building unti12008. We have already contracted with Merril Landscaping to come in and finish the landscaping, and they have given us a launch date of April 10, 2008, as the date they will begin such process. As mentioned, it was our good faith intent to have the landscaping project completed within the requisite time frame, but due to delays by the landscape company, and the financial restrictions placed upon us, we have not been able to comply. To that end, we ask that we may be granted an extension of our temporary occupancy unti12008, when we will be able to complete the landscape project.
