AN ORDINANCE ANNEXING CERTAIN LANDS TO THE
CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS
AND DECLARING SAME A PART OF THE CITY', OF
REXBURG, IDAHO; AND AMENDING AND CHANGING THE
ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND
THE CLASSIFICATION OF THE SAME UNDER THE ZONING
ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
WHEREAS, the lands hereinafter described are contiguous and adjacent to the
ity of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City
been requested to annex the same to the City of Rexburg, Idaho, and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg,
io, that the hereinafter described properties are subject to annexation to the City of
burg under and pursuant to the provisions of Section 50-222, Idaho Code, and that
.lands should be annexed to and become a part of the City of Rexburg, Idaho, and
WHEREAS, the City Council referred the zoning of the affected territory for
~rt and recommendations to the Planning and Zoning Commission, and the Planning
Zoning Commission made its report and recommendations for zoning classification
f the hereinafter described properties proposed to be annexed, and
WHEREAS, the Council has determined that the proper classification under the
Ordinance of the City of Rexburg, Idaho, for the properties to be annexed are as
set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
OUNCIL OF THE CITY OF REXBURG, AS FOLLOWS:
SECTION I. That the following described lands situated in Madison County,
[daho, to-wit:
The proposed zoning for the annexed lands is defined as follows:
Tract 2: Community Business Center (CBC)
Tract 3: Community Business Center, Rural~,Residential 1
Tract 4: General Business Center, Regional Business Center,
Rural Residential 1 (GBC, RBC, RRl)
Tract 5: Rural Residential 2 (RR2)
These properties are located in the Rexburg City Area of Impact, Madison County,

Tract 2 -Beginning at a point that is North along the Section line 561.00 feet
from the West quarter corner of Section 36, Township 6 North, Range 39 East,
Boise Meridian, running thence North along said Section line 30 feet; thence East

City of Rexburg.
Also, all of that property that is east of the South Yellowstone Highway in the

hereby declared to be a part of the City of Rexburg, Idaho.
SECTION II: That the above described properties hereby annexed to the City
of Rexburg be, and the same are hereby classified under the Zoning Ordinance of the
City of Rexburg as above set forth; that the Zoning shall be amended to show this
annexation and classification of the above described properties so annexed and that
said amendment shall be certified to and declared to be the official Zoning Map of the
City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg
endorsed thereon.
SECTION III: This ordinance shall be in full force and effect from and after
its passage, approval and due publication.

NOTICE IS HEREBY GIVEN, that a joint Public Hearing will be held before the Planning
and Zoning Commission and the City Council of the City of Rexburg, Idaho, Wednesday,
December 14, 2005, at 8:00 p.m., in the City Council Chambers of the City Building at 12
North Center, Rexburg, Idaho, regarding annexation of certain properties. The proposed
zoning for the annexed lands is defined as follows:

2005 ANNEXATION PLAN
Novembet• 22, 2005
In accordance with Idaho Code Title 50-222, S.a.b.iii, the City provides the following information
pertaining to the areas and/or parcels shown and numbered on the attached map (Attachment A):
It is proposed that the City of Rexburg would annex several areas and/or parcels into the City. At
least one of these areas is a petitioned annexation by the property owner. Other areas adjacent to
and/or encapsulated by these parcels are also included in this annexation plan and may be
considered for annexation by the City of Rexburg.
The extension of infrastructure to these areas has already been started and/or completed and the
City anticipates servicing all new developments within in the area with municipal services as
soon as is practicable.
Water and Sewer services are already extended to the parcels on the South Yellowstone Highway
and are extendable to the other proposed parcels.
(a) Tax supported municipal services to be provided to this newly annexed area include
police, fire and other city services including snow removal, public works, building
Department and planning and zoning services.
(b) Changes in the rate of taxation are described on the attached flyer (Attachment B)
"Annexation in the Cit~of Rexburg"
(c) Fee supported City services; including water and sewer are immediately adjacent and/or
extendable to all of the proposed properties.
(d) Annexation of described areas will have very little impact to other local government
taxing districts outside of the Fire Protection District. This impact is approximately
$60.04 per $120,000 of taxable value.
(e) Proposed zoning in annexed lands is defined as follows:
a. Tract 1: Rural Residential 1(RR1)
b. Tract 2: Community Business Center (CBC)
c. Tract 3: Community Business Center, Rural Residential 1
d. Tract 4: General Business Center, Regional Business Center, Rural Residential 1
