Nature of Request (Briefly explain the proposed use) Conditional use permit to construct and operate a Head Start Early Childhood Education Center Existing use of property: 1 REQUIREMENTS FOR GRANTING CONDITIONAL USE PERMIT The number of occupants is based on the requirements of the IBC 2003 Edition for a mixed use of Occupant Group E and Occupant Group B. Total occupancy using the above criteria is 58 occupants. 1. What is the estimated water usage per month? Are the existing mains adequate to provide fire protection? 23,000 gallons per month, yes mains are adequate. 2. What is the estimated sewer usage per month? Will pretreatment be necessary? 20,010 gallons a month without special treatment required. 3. What is the estimated daily traffic to be generated? Will the traffic be primarily private vehicles or commercial trucks? Two sessions per day of 17 students which will generate approximately 80 vehicles per day. The traffic will be by private vehicles. 4. If commercial, industrial, or a home occupation, what will be the hours of operation? Based on the "Head Start Center Design Guide", published by the U.S. Department of Health and Human Services Administration, pre-school and younger children may spend nine or more hours at the center. 5. Will storm water drainage be retained on site? Is an existing storm drain available? Is it at capacity? If so, will new facilities be constructed? There is sufficient area on the site to retain storm water drainage from 80% of the structure rain-off and all of the planting area on site. 20% of the structure and the hard surfaces of the parking area storm water drainage will go into the existing storm sewer system. The nearest catch basin is on the corner of the east side of North 1st West, approximately 359'-0" from the site. The curb and gutter fronting the property on East 2"a North slopes to the catch basin at North 1st West. The storm water drainage area of the site is relatively small and should not impact the storm system. 6. Residential Usage: The Head Start Facility is not intended for residential usage. • 7. What provisions has been made for fire protection? Where is the nearest fire Hydrant? Is any point of the building further that 150 feet from access sufficient in width for fire fighting equipment? The building will be designed and constructed in accordance with the 2003 IBC and related fire, mechanical, plumbing and electrical codes to insure adequate life safety and fire protection is met. Afire hydrant is located across East 2"d North in line with the east property line of the proposed Head Start site. A distance of 150 feet from this fire hydrant extends 80'-0" into the site with adequate room to fight a fire. 8. How much parking is being provided on site? Do the aisle widths and access Points comply with the ordinance requirements? Has landscaping been provided in accordance with the ordinance? Parking on site will meet the requirements of the parking ordinance. Aisle widths and access points will comply with the ordinance requirements and are detailed on the attached site plan. Landscaping of the property will meet the requirements of the ordinance. 9. Where will solid wastes generated be stored? Is access adequate for the City collections? The adjacent property, Twin Pines Manor is the property of E.I.S.S.A., the owner of the Head Start property. Currently the Manor's garbage dumpster is located on the northeast corner near the property lines. We would locate both the Manor dumpster and the Head Start dumpster together for adequate and easy pickup of both dumpsters. 10. What is the type of noise that will be generated by the use? What are the hours of noise generation? Noise generated by children from birth to pre-school children at play. In this particular site, the noise from these children will not be noticed. Hours of noise will be approximately the hour of noise in other neighborhood elementary school at considerably less sound level. 11. What type of equipment will be used in conduct of the business? Inside the Head Start facility typical pre-school materials and equipment. Outside playground equipment appropriate to the ages of the children. 12. What are the surrounding land uses? Has buffering been provided as required by the ordinance? • • On the east and west side of the property are multi-family housing, a park area for the multi-family housing is on the south end of the property. On the north side across West 2"d North is the yard of Zollinger Construction. The Head Start facility will have fenced play areas. No other type of buffering is required. 13. Are any air quality permits required? Is dirt or other dust creating materials moved by open truck or box cars? The answer is no to both questions. 14. Will the parking lots or other outdoor areas have lighting? Yes, exterior illumination of the building and parking area will be similar to the housing projects on both sides of the property. 15. Are passenger loading zones for such use as daycare centers and schools provided? How is busing routed? For commercial uses, where are the loading docks? Is there sufficient space for truck parking? A dedicated passenger loading zone will be provided at the entrance to the facility separated from the staff and visitor parking area. School buses will not be used, passenger vans would be the largest vehicles used. There are no loading docks or truck parking required. Food delivery will use the passenger loading area between student pickup and drop off times. 16. If a commercial, multi-family or public assembly use, where is the nearest collector street? Arterial street? The Head Start facility is none of the above uses. 17. What, if any, signage is anticipated in connection with the proposed usage? Traffic control signage for the control of the loading/unloading zone and for the parking area. Signage identifying the facilities. The Commission or Council may address other points than those discussed above, but a narrative addressing at least these applicable points will assist in processing your • application. Kay, City Clerk ~ _~ Published: November 26th, 2005 December 10th, 2005 • Planning & Zoning Public Hearing Minutes -December 14, 2005 8:30 P.M. -Conditional Use Permit to construct and operate a Head Start Early Childhood Education Center. -Eastern Idaho Community Action Partnership. Kay Howard of 4064 East 376 North Rigby asked the Commission for a Conditional Use Permit to build a Head Start Center at 55 W. 2"a N., next to Twin Pine Apartments. The head Start Center will serve thirty-six students who will attend classes Tuesdays through Fridays. The Center will include seven staffers and volunteers and a handicap playground. Parents will bring their students to the center each day. No transportation will be provided. The Center offers low- income education, emergency use, and other services that are planned for the future. P&Z Administrator Kurt Hibbert reviewed the site plan on the overhead screen. Zoning is already appropriate. The Staff is working with the Engineer to approve the building to comply with the design standards. The architect is willing to shift the building slightly in order to comply. Commissioner Mary Ann Mounts asked for drop off times. They are planned from 8:00 to 8:30 A.M. and 12:00 to 12:30 P.M. Commissioner Mary Ann Mounts it is a great thing for Rexburg to~et. It is a really great program that is needed for Rexburg. Her only concern is traffic on 2n North at 8:00 A.M. when people are leaving for work. Commissioner David Stein asked about impact on adjoining property buffering. There will be a chain link fence around the playground. Commissioner Thaine Robinson asked if Staff would be involved in the development of the site plan. P&Z Administrator Kurt Hibbert said yes. There will be an open atmosphere design. The drop off for cars will be off of the street. The front entrance is designed as aturn-around, which adds to the children's safety. Commissioner Randy Porter asked if this fits with the emergency services regulations. The site plan can still be adjusted for staff approval. Kay Howard wants to open by next fall. Commissioner Thaine Robinson opened the Public Hearing. Those in favor of the proposal: Loraine Flannery at 138 North 3ra East in Rexburg is a teacher at Head Start who feels that they need a better facility. The children need more space. This will meet the needs of the children, so she was in favor. ..~ Carol Flannery, also of 138 North 3ra East, indicated that the current conditions are deplorable. The children need a better facility. There is a waiting list. There is not a play ground for the children. Rexburg deserves better. It does not take local tax dollars, it is federally funded. She would like the City Council to look very hard at this decision so Head Start won't lose that funding. She was in favor of the proposal. Gary R. Martin sent in a letter in favor of the proposal (letter is on file). Those neutral -NONE Those against -NONE Commissioner Mary Ann Mounts moved to approve the proposal; Commissioner Mary Haley seconded the motion; Discussion: This the first time the Planning Commission has seen the proposal. It has not been delayed by the Planning Commission. Commissioner Mike Ricks said it is a good use of tax dollars. All voted aye, none opposed. Please forward to the Commission's agenda. As a local photographer, I had the opportunity to take a series of photos of the children and staff activities at the Rexburg Headstart Center last spring. While visiting their current building location, the overriding thing that impressed me, besides the apparent working relationship they have with the children, was the lack of space and adequate working room available at the center. I realize they have to work under whatever current rental/lease agreement they have on the existing building (small residential house), but I could not believe the crowded conditions they are working under. That day they had the manager, (2) two teachers, a cook, 14 children, and I believe there were three (3) young ladies from BYU-Idaho doing an internship in child development all working in that small, 4 room house. At times the noise level can get a little high from several little, sometimes excited, children voices. And as a previous instructor for seven (7) years at Eastern Idaho Technical College, I understand the conditions this staff would struggle daily thru to keep the children's attention, get teaching points across and do proper evaluations. There would also, it seem to me, to be some safety issue for the staff trying to be constantly aware of possible injuries or a sudden illness during children's activities. I venture to say there is some stress level for the staff due this over-crowding...In short, they need a larger Center facility in Rexburg. I have before me a newspaper article stating they are in fact applying for a building permit to build such a facility. In the article it states the P&Z committee has to vote on a zoning change from high density residential to whatever the code requires for such an operation. And the commission is announcing they asking for comments on making such a necessary change. I am somewhat familiar with that new location. I know that just west of the proposed building site are apartment complexes, and within a couple hundred feet are 2-3 commercial ventures; a real estate office and retail floral store to name two. I personally would like to see this request for zoning change be approved and allowed to move forward so Headstart can apply for their building permit. I do not see where this Headstart operation is going to add drastically to any increased traffic in the neighborhood. It will certainly be less than if additional high-rise apartments continue 11/30/2005 Page 2 of 2 to be built on that vacant lot. And the small Headstart operation certainly would not appear to disrupt any other activities in that neighborhood. I would highly recommend the commission members make the necessary zoning change in order for the Headstart Educational Center to go ahead with their plans to build there. It would certainly be to the benefit of the children's pre-school opportunities for the Rexburg area. Thank you for your attention. Sincerely, Gary R.
