Findings of Fact
Indian Hills Neighborhood Association
Rezone
1. On October 6, 2005 Bryce B. Thueson, representing the Indian Hills Neighborhood Association,
presented to the Rexburg Planning & Zoning Secretary a Request and Application for a Rezone from
Low Density Residential Two (LDR2) to Low Density Residential One (LDRl).
2. On October 25, 2005, the City Clerk sent the Notice of Public Hearing to be published in the local
newspaper for October 29, 2005 and November 12, 2005. A notice was posted on the property and sent
to all property owners within 300 feet of the above mentioned property.
3. On November 17, 2005, Bryce Thueson -President of the Indian Hills Neighborhood Association -
presented to the Rexburg Planning & Zoning the request for a Rezone from LDR2 to LDRl. He
explained that the areas surrounding the Neighborhood are LDR1 and that it would be a good fit. They
wanted to prevent any future homes being turned into apartments. Mary Ann Mounts motioned to
allow this Neighborhood that has been outlined to be changed to LDR1. Joe Laird seconded the
motion. None opposed. Motion carried.

Planning & Zoning Public Hearing Minutes -November 17, 2005
A. Rezone -Indian Hills Neighborhood Association - 7:35pm
Bryce Thueson - 301 Mohawk -President of the Indian Hills Neighborhood Association.
He explained that their proposal is to rezone the homes along the East side of 4th E down
to Rolling Hills Dr., the homes on the North side of Rolling Hills Dr. to Shoshone, the
homes along the West side of Shoshone that go up to 2"d S (the Randall Hill Subdivision
plus the homes on the North side of Rolling Hills Dr. from 4th E to Shoshone). They
requested to be rezoned from Low Density Residential Two (LDR2) to Low Density
Residential One (LDRl), which would limit or stop the apartments from coming in.
Mr. Thueson felt that by rezoning to LDRl, it will further stabilize the neighborhood.
The Neighborhood to the South is currently zoned LDRl as well as along Mill Hollow,
so they felt this zone would fit well for their Neighborhood and the surrounding area.
Chairman Dyer asked about the number of membership of the Neighborhood
Association, the efforts to get the word out about the proposal, meetings that might have
been held, and how many are for the proposal and against.
Bryce Thueson reported that everyone had been contacted from the boundaries that are
requested to be rezoned. A letter has been sent out and a representative from the
Planning Committee of the Neighborhood Association to contact all the homes to ask if
the residents wanted to be a part of the Neighborhood Association. Last week, they held
a meeting at Lincoln School for the members of the Neighborhood Association to discuss
what they wanted to do. One of their main focuses for creating the Association was to
create this rezone for the properties. The Association does not include everyone, but
everyone has been contacted.
Chairman Dyer asked what the percentage indication of those in favor of this change in
zoning. Bryce Thueson estimated more than 75% of the people want to rezone; maybe
closer to 90%. There was a petition signed supporting rezoning the neighborhood.
David Stein asked if Mr. Thueson had any idea how many basement apartments are
currently in the neighborhood. Bryce Thueson estimated about half a dozen. He added
that at the last meeting they did discuss that those who currently have an apartment that is
legal according to the City is grandfathered; they can keep their apartment and it can
transfer to the new owner.
Thaine Robinson commented that the minimum lot requirement for LDRI is 12,000 sq.
ft. with 80 foot frontage. He asked if all the homes meet that requirement. Kurt Hibbert
explained that most of those homes are too small, but they will be grandfathered and
considered legal nonconforming lot sizes.
Chairman Dyer opened the public input portion.

Rick Davis - 530 Comanche Dr. He was in favor of the proposal. He was one of those
who went door to door. There was one person who was opposed to the proposal.
Everyone else he spoke with was in favor of the proposal.
Carrie Mills - 290 Shoshone. She went door to door down Shoshone. She had one
gentleman who had an apartment who was absolutely for it and he understood that he
would still be able to have his apartment. She did not find any controversy that came up.
She felt it was unanimous on her street.
Boyd Withers - 266 Nez Perce. He contacted a number of people on Nez Perce; no one
was opposed -two were not home.

Marilyn Clark - 329 S 4th E. She had a question regarding adding square footage under
her home for her son who has a disability. She was wondering if that would be a problem
if she tries to do something like that.
Chairman Dyer invited her to confer after the meeting with Mr. Hibbert.

Randall Porter commented that he liked the proposal. Mary Ann Mounts added that
she liked it because they are surrounded by LDR1.
Chairman Dyer commented that he would like the record to reflect the efforts of the
Neighborhood Association to organize this and do their "do diligence" and bring
documentation and information before the Commission for consideration. He wanted to
hold this up as a model of how this should be approached. He appreciated their efforts.
Mary Ann Mounts motioned to allow this Neighborhood that has been outlined to be
changed to LDR1. Joe Laird seconded the motion.
None opposed. Motion carried.

City Council Public Hearing Minutes -December 14, 2005
8:40 P.M. -Rezone properties from LDR2 to LDRl east of South 4th East between
2na South and 350 South. (Indian Hills Neighborhood Association)
Mayor Larsen asked P&Z Administrator Kurt Hibbert to review the Proposal. The Planning
and Zoning Commission approved the request to go from LDR2 to LDRl which will deny future
apartments in this neighborhood.
Mayor Larsen asked P&Z Administrator Kurt Hibbert if it was an Association.
Bryce Thueson at 301 Mohawk Avenue reviewed the request to limit duplex rentals in the
neighborhood. They wanted to protect their neighborhood as an adjoining neighborhood did last
year.
They are concerned with the neighborhood transitioning into non-owner occupied rentals.
Those in favor of the proposal -Bryce Thueson was in favor of the proposal.
Carrie Mills at 290 Shoshone Avenue indicated that it mergers with adjoining LDRl property.

Those against -NONE
Council Member Fullmer reviewed the boundaries of the proposal.
The Public Hearing was closed.
As the Planning and Zoning Liaison, Council Member Erickson indicated that Planning and
Zoning discussed it at length. Some questions were resolved and they approved the zoning
change from LDR 2 to LDRl .
Council Member Anderson appreciated the neighbors working with the City to protect their
neighborhood from transitioning into an absentee landlord neighborhood.
Council Member Young moved to change the zoning of the Indian Hills and the North Side of
Rolling Hills from LDR2 to LDR1. Council Member Fullmer seconded the motion. All voted
aye, none opposed. The motion carried.
Mayor Larsen thanked the neighbors for making the City's job easier.
Council Member Benfield congratulated them for their organization and professional
presentation.
