On March 25, 2005 Terry Bagley presented to the Rexburg Planning & Zoning Secretary a Request and Application for a Rezone from Light Industrial to Technology and Office Zone. The two parcels are RPRXBCA0257207 and RPRXBCA0257285. 2. On March 29, 2005, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for Apri12, 2005 and April 16, 2005. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 3. On April 21, 2005, Terry Bagley presented to the Rexburg Planning & Zoning Commission the Request to rezone his two parcels. Because the code was just being adopted and needed some additional information, that particular application was tabled until the requirements of the particular zone had been developed and put forth in the ordinance. Randall Porter motioned to table further action. Stuart Wells seconded the motion. None opposed, motion carried. 4. On June 13, 2005, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper for June 18, 2005 and July 2, 2005. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 5. On July 7, 2005, Terry Bagley presented to the Rexburg Planning & Zoning Commission the Request to rezone his two parcels. Since April 21, 2005 meeting, the zone had been further developed and amendments for the Development Code were approved. David Stein moved to recommend to City Council that the Terry Bagley property North of Trejo street be rezoned to Technology and Office Zone from Light Industrial. Mary Ann Mounts seconded the motion. None opposed. Motion carried. 6. On August 17, 2005 P&Z Administrator Hibbert explained the request for Mr. John Bagley. It is a business park to attract high-end professional businesses. This is the first request for a Technology and Office Zone. Council Member Erickson conveyed to the City Council that the Planning and Zoning Commission did recommend this proposal for approval. Council Member Erickson moved to approve the re-zone request north of Trejo as requested from Light Industrial (LI) to Technology and Office (TO) Zone for the area north of Trejo Street; Council Member Anderson seconded the motion; all voted aye, none opposed.
