Site Location: 48 East Main Street, Rexburg, ID (Bio-medics Plasma Center) Owner: Canyon Gate Capital Corp Owner Contact Info: Site address Initiating Cause of Investigation: Citizen's Complaint regarding the sidewalk along the East side of College was blocked for pedestrian traffic due to construction debris. The building Official had directed the contractor (A & H Construction) to maintain a minimum of five (5) feet of clearance from the back of the curb. This officer responded at approximately 1300 hrs. to the site. (February 23, 2005) There were no Contractor's employees present, outside when this officer arrived, so I went inside to contact the Superintendent for the job. A construction worker directed me to the front of the facility, where he thought the Supt. could be found. Upon entering the blood drawing room, this officer observed the following conditions: Over 15 donors were on the drawing couches, connected to the plasma extractors, which is to say that the operation of the business was in full swing, and open to the public for donations. The contractor also was performing construction work, employing power tools and the required construction material to accomplish the re-model work permitted by Building Permit No. 05 00005, issued by The City of Rexburg in December of 2004. The floor of the blood drawing room was literally covered with construction debris and dust. The dust in the air was clearly visible to the eye, and coated everything in the room, inclusive of the near-ceiling mounted TV's and the clothing of the donors. Additionally dust was clearly present on the Blood Re-cycling and Plasma extractors being employed alongside the donors. 1 • Tliis Officer immediately addressed the first issue, which prohibits the Contractor from either working on construction when the public, or non-project associated personnel are present in 5the construction zone, or requires him to maintain public safety by denial of public access to the construction site. The Supt. for the Contractor (Mr. Kent Hillman), stated that the owner had refused to shut the business down during construction. This Officer advised Mr. Hillman that that was not a defense or justification for violation of State and Federal Laws. (Labor and Industry, and OSHA/ISHA), nor violation of the International Building Code, and/or the local Life Safety requirements of the City. The indication, on the part of Mr. Hillman, was that there appeared nothing he could do. Given this Officer's experience as a Commissioned Warrant Officer (Hospital Corps, USN) early in his career, and his subsequent understanding of the definitions and requirements to establish a safe bio-medical environment, in the presence of blood serums, coupled for what he perceives as his responsibility to the city government and the public at large, pursued the following course(s): 1. He confronted the young lady who stated that she was in charge, and ordered her to close the operation on the plasma center at once, and remove the public donors forthwith. (to her credit, she offered no resistance, but ordered the donors out and the operation shut down., without argument.) He further advised her that the level of contamination, or the appearance thereof would require that the plasma extracted should be destroyed, and not distributed for human use. If any contamination had entered the process it seemed logical that the recycled red blood cells may pose some liability in the donors themselves, regarding this incident. This Officer was advised that the observed condition was limited to the operations of this date only. 2. This Officer took digital pictures of the drawing room to illustrate the debris and dust present throughout. 3. This Officer contacted Lt. Ron Larson, Patrol Division Commander, requesting that City Police Respond to serve as supportive observes and witness to the actions of this Officer. Within a few minutes two units responded (Officers Lyndon Baron and Troy Dameron), to assist and witness the site and it's conditions. 4. This Officer spoke with the Owner of the Plasma Center, when that owner was contacted by the Center's Manager. (I had initially identified myself and given out business cards when confronting the Center Management.) Gary and I spoke for a short time and I detected nothing but cooperation on his behalf. We ended the discussion amicably, and I saw no need to relay the allegations, or the attitude, of the Contractor that the Center was wholly to blame. 5. This Officer advised the Management that they would remain closed until any, and all work by the contractor was completed in the Blood Drawing Room and the front offices, and the Bio-Medical Environment was restored to State and Federal Standards. The last was left as the responsibility of the Center, given that the City has neither, the equipment, the skill, nor authority, to deal with this aspect. Given the separation of the Blood Drawing Room, from the larger portion of the remodel project at the rear of the building, this Officer stated that completion of the separation, and maintaining the separation would be acceptable for this Officer to allow resumption of operations. (given 2 • • restoration of the Bio Medical environment and completion of all construction and clean up at the front of the building. Noting the posting of the front, and public entrance, that the Center was "Closed until further Notice" This Officer left for the day, and subsequently advised the City Clerk and the Director of Community Development of the situation, and the actions taken by this Officer. 6. Lastly, this Officer met with the Director of District VII, Health Dept., to determine whether the city, or this officer, was required to report the matter to them, or any other agency. Mona advised that the matter regarding a plasma center was neither in the Department's jurisdiction, nor was any report required that she was aware of. The Center was inspected yesterday, by Jon Berry, of the Building Department, at this Officer's request for compliance with both the permit requirements and the directions of this Officer. Additionally, this Officer visited the site frequently to assure himself that the effort was both diligent and effective. This morning, this Officer inspected the Center and determined that all surfaces in the front and Drawing Room had been cleaned and totally repainted, that all construction in accordance with the approved plans was completed and no evidence of the contractor was present in the operational area. The extractor units had been sanitized and they had worked all night to ensure that the directions of the city were met. Given the results of the inspection by this Officer, and a report from Jon Berry, and discussion with him, this Officer allowed the Center to open at approximately 0900 hr. this date. The opening action was reported to both the City Clerk, and The Director of Community Development. Investigation Summary: This Officer holds that summarization be limited in regard to scope and seriousness of the incident, given the Center's "voluntary" closure and the amount of energy and expense sustained by both the owner and the contractor in response and remedy' be as follows: Possibly due to some lack of understanding of risk, on the part of the remodel contractor,. compounded by inattention of his work. force, the Bio-Medical environment was adversely impacted to some unknown degree. The response was immediate and effectively prevented further deterioration of the Medical environment and aided by the immediate and effective inter-departmental assistance of the City of Rexburg, an immediate remedy and plan of action to protect the public and community standards was developed and implemented. The owner and staff of the Plasma Center has been notified that the Building Department will be asked by the Enforcement Division to withhold Final approval under the Building Permit for renovation, as well as withholding the permanent occupancy certificate, until the center's medical and operational environment has been updated and approved by the State Licensing authority, a process which they encountered when they initially opened. The owner has agreed to, and endorsed this. requirement. City of Rexburg, Idaho Dear Chief Archibald: Bill Hamlin Enforcement OfFcer This letter is to express the appreciation of the Community Development Department, and specifically, the Enforcement Division for the outstanding response of your Officers under our Inter-Departmental Mutual Assistance Agreement. Additionally, it is written to commend to your attention, the individual Officers who responded so effectively, in the absence of you and Capt Lewis, on 23 February, 2005. The incident involved the Plasma Center (Bio-Medics) on East Main Street. I have attached a copy of my investigation and report for your review and understanding. Initially, I contacted, (after the initial sight review and issuance of direction to cease all operations of the Center),. Officer Angela Maurer, City Dispatcher, with my assistance request. She put me in contact with Lt. Ron Larson, who was in conference with the. County Prosecutor, but who directed me to contact Officer Lyndon Baron. I requested Officer Baron's assistance at the site, and very shortly, both he, and Officer Troy Dameron, were on site at the Center. I advised them that I considered the issue to be civil in nature, and also that I had directed cesseation of all Plasma extraction operations, since the conditions represented a degredation of the required medical environment to a point of creating a "clear and Present" violation, and possibly danger. I requested that they observe bath my actions, and existent conditions, should wittnesses be required. While there was no resistance from the Center management, or employees, there were over 15 donors present, from the community at large, who had no understanding of the situation. The appearance of the Officers, in their tradionally neat and sharp uniforms, coupled with their • calm and professional demean certainly presented all with reassuarance, and "kept the peace". Should you choose not to accord special recognition, please convey my apprecaiation to them all. I dealt with the conditions as I found them, and the issue may well have been one of totally unacceptable "appearances" of professional disregard by the Contractor, the Center Management, and the medical technicians performing the blood drawings and allowing the public in an active construction zone. Both your Officers -and this author received words of appreciation for our intervention from the Medical Staff, after the fact. As you can see from review of my attached report, the matter is well under control, and not likely to occur again. Having had the benefit of removal from operational necessesity for a couple of days, I am persuaded that the risks and threats presented came about by a lack of cooperative understanding among the players, and a lack of knowledge, on their part as to what to do when the conditions went sour. The rather got into it by strong focus of their understanding and needs without understanding of the responsibilities of the other players, although they all strove for the same goal. The Contractor was blindly focused on his contract responsibilities to perform the construction; the Center management focused solely on continued operations; the donors were focused on their income, and the floor staff was only concerned with blood drawing and plasma extraction. Each party being determined to carry out their job, or attain their goal, the conflicts came into existence. Perhaps another instance of "It can't happen in Rexburg". I believe all things worked well, given conditions, and the public was protected, and risk of liability was reduced, if not eradicated. Thanks again Chief, to you and the Department Staff.
